AN ORDINANCE TO AMEND SECTION 2 - 10 OF THEA FIN VrL� LE CODE
OF ORDINANCES ; TO PROVIDE THE DUTIES FOR WHICH THS' r h ATTORNEY
SHALL RECEIVE THE REGULAR SALARY ESTABLISHED BY THE ANNUAL
BUDGET ; TO RATIFY AND APPROVE THE PROSECUTION OF CASES INVOLVING
VIOLATION OF STATE LAWS COMMITTED WITHIN THE CORPORATE LIMITS ; AND
FOR OTHER PURPOSES ,
Whereas , Section 2 - 10 of the Code of Ordinances of the City
of Fayetteville outlines the general duties for which the City
Attorney is paid the regular salary established by the annual
budget , and
Whereas , said Section 2 - 10 does not specifically list the
prosecution of civil and misdemeanor criminal cases involving
the violation of state laws which occur within the corporate
limits of the City of Fayetteville , and
Whereas , since the adoption of said Section 2 - 10 the Board
of Directors has indicated by the adoption of Ordinance No . 1552
( Sec . 14 - 7 of the Code of Ordinances ) that the City Attorney may
try cases involving violations of state law committed within
the corporate limits of the city , and
Whereas , the Board of Directors deems it desirable that the
City Attorney prosecute cases involving violations of state laws
committed within the corporate limits of the city , and
Whereas , the Board of Directors deems it desirable to specifically
state that the prosecution of civil and misdemeanor criminal
cases involving the violation of state laws which occur within
the corporate limits of the City of Fayetteville is within the
duties for which the City Attorney is paid the regular salary
established by the annual budget .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That section 2 - 10 of the Code of Ordinances ,
City of Fayetteville , Arknasas is hereby amended to read as
follows :
" Sec . 2 - 10 . City Attorney - general duties
The duties of the city attorney shall be as follows :
( a) To prosecute all cases whether civil or criminal
involving the violation or enforcement of city
ordinances before the municipal court ; to prosecute
all cases whether civil or misdemeanor criminal cases

involving violations of state laws within the corporate
limits of the city before the municipal court or
circuit court and to prosecute or defend all appeals of
any of such cases from the municipal court to the circuit
court .
(b ) To perform routine duties for the water and sewer
departments , to furnish legal advice to the mayor or city
manager , city council aldermen , or board members , chief
of police , chief of the fire department , city controller ,
city clerk , chairman of the civil service commission , and
chairman of the planning commission , and all other city
officials and administrative heads of departments of the
city , whether elected , appointed or employed by the city .
( c ) To draft all ordinances , resolutions , contracts ,
leases , conveyances , bonds , and such other instruments of
writing as may be required by the business of the city .
( d ) To furnish written opinions upon subject of a legal
nature relating to the affairs of the city government
requested by any city official or administrative
department head .
( e ) To attend city council meetings and upon request
t; therefor , any meeting of the civil service
commission , board of adjustment , board of appeals ,
planning commission , or any other administrative board
of the city government . "
Section 2 . That any action the City Attorney or previous
City Attorneys may have taken in the prosecution of civil or
misdemeanor criminal cases involving violation of state laws
committed within the corporate limits of the city prior to the
effective date of this ordinance be and it hereby is in all things
ratified and approved . This ratification and approval shall
apply to all causes presently pending , if any , and to all causes
concluded prior to the effective date of this ordinance , if any .
Section 3 . Should any section or provision of this ordinance
be declared by the courts to be unconstitutional or invalid ,
such decision shall not affect the validity of the ordinance
as a whole , or any part thereof other than the part so declared
to be unconstitutional or invalid .
Section 4 . This ordinance being necessary to specifically
state all duties for which the City Attorney is paid the regular
salary established by the annual budget and necessary for the
preservation of the public peace , health , comfort , convenience ,

morals , safety and welfare of the City of Fayetteville , an
emergency is declared to exist and this Ordinance shall be in
full force from the date of its passage and approval .
