YER CI:i 'vl Lci; 1C AN ORDINANCE ESTABLISHING MINIMUM PLUMBING STANDARDS ; ADOPTING THE ARKANSAS STATE PLUMBING CODE ; PROVIDING AMEND - MENTS TO SAID CODE ; AND FOR OTHER PURPOSES . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . That Section 15 - 1 of the Code of Ordinances , City of Fayetteville , Arkansas , is hereby amended to read as follows : " Sec . 15 - 1 . State plumbing code , etc . , adopted by reference . There is hereby adopted by the Board of Directors of the City of Fayetteville , Arkansas , by reference thereto the pro - visions set forth in the pamphlet entitled "Arkansas State Plumbing Code , Rules and Regulations of the State Board of Health , Governing the Construction , Installation and Inspection of Plumbing and Drainage , 1971 Fifth Edition , issued by the Arkansas State Board of Health , Little Rock , Arkansas , " together with the provisions of the pamphlet _entitled " Septic Tank Systems , Arkansas State Board of Health , Bureau of Sanitary Engineering , Bulletin No . 9 , 1969 Edition , " save and except such portion of said pamphlets as are hereinafter deleted , modified or amended and the provisions contained in said pamphlets are hereby adopted and incorporated as fully as if set out at length herein , and the provisions thereof shall be controlling within the corporate limits of the City of Fayetteville , Arkansas . " Section 2 : That the Code of Ordinances , City of Fayetteville , Arkansas , is hereby amended by adding a section to be numbered 1S - 10 . 1 , which said section reads as follows : MICROFILMED 3 �Sjt DATEF-,.�_ REED— DEED 3QI PAGE 690 " Sec . 15 - 10 . 1 Reciprocal Licensing When an applicant submitting an application for a city plumbing license holds a similar Arkansas State Plumbers License for the current year , and Said applicant presents satisfactory evi - dence that he has made a passing grade on a written examination given by the Arkansas State Committee of Plumbing Examiners for his original similar Arkansas State Plumbing License , and Said applicant pays the required city license fees as set out in these regulations , the city plumbing inspector shall issue said applicant his city plumbing license without further examination by the City Plumbing Examining Board . " Section 3 . That Section 15 - 11 , sub - section ( 4 ) of the Code of Ordinances , City of Fayetteville , Arkansas is hereby amended to read as follows : " ( 4 ) Deferment fee . A fee of three dollars ( $ 3 . 00 ) shall be charged each time an applicant applies for a deferment of his license to cover special deferment services connected with the deferment of a city plumber ' s license . (Ord . No . 1433 § 11 , 2 - 15 - 65 ) " Section 4 . That Section 15 - 12 , of the Code of Ordinances , City of Fayetteville , Arkansas is hereby amended to read as follows : " Sec . 15 - 12 . Apprentice plumbers . A person who is qualified under the Arkansas State Apprentice Program shall be permitted to work inside the City of Fayetteville , Arkansas , as an apprentice plumber provided DEED 83' 0 PAGE 691 - 2 - he complies with all of the following conditions : I ; . 1 ) State Apprenticeship Card . The apprentice plumber hold a current apprenticship card issued to him by the Arkansas State Committee of Plumbing Examiners . 2 ) Schooling Requirements . The appren - tice plumber must be in good standing with the Northwest Arkansas Plumbers Apprenticeship Committee by regular attendance at the Northwest Arkansas Apprenticeship School or , The apprentice plumber must be in regular attendance at a college , trade school or correspondence course which is recognized and accepted by the Fayetteville Plumbing Examining Board . 3 ) Registration . The apprentice plumber must register with the plumbing inspector and he shall be required to notify the plubming inspector each time he changes employment to work for another master plumber . 4 ) Supervision . The apprentice plumber working in the City of Fayetteville , Arkansas , shall work at all times under the direction and constant personal supervision of a licensed journeyman or master plumber . An apprentice plumber who qualifies under the requirements of the Arkansas State Apprentice program to - - work on a plumbing job alone may also work in Fayetteville , Arkansas , on a job unsupervised . DEED 830 FnG[ 0zl2 3 5 ) Registration fee . Every apprentice plumber working in the City of Fayetteville Arkansas shall pay a one dollar ( J1 . 00 ) registration fee . This fee shall be payable each year . " Section 5 . That the Code of Ordinances , City of Fayetteville , is hereby amended by adding a sub - section to be numbered Sec . 15 - 14 ( 1 ) ( i ) , which said sub - section shall read as follows : " ( i ) Each separate mobile home space shall be considered as being a plumbing fixture when obtaining a plumbing permit to plumb a mobile home park . " Section 6 . That Sec . 15 - 14 sub - sections ( 2 ) ( f) ( 1 ) and ( 2 ) of the Code of Ordinances , City of Fayetteville , are hereby amended to read as follows : " ( 1 ) A fee of twenty dollars ( $ 20 . 00 ) when the city plumbing inspector makes a percolation test and inspects a new septic disposal field installation for the minimum requirements as oultined by the Arkansas State Board of Health . The required percolation holes being dug and water for making the test furnished by the plumber or property owner prior to calling the city plumbing inspector for a percolation test . ( 2 ) A fee of fifteen dollars ( $ 15 . 00 ) when the city plumbing inspector makes an inspection of an extension to an existing septic disposal field installation , or when the city plumbing inspector makes an inspection of a new septic field installation for the minimum requirements as outlined by the Arkansas State Board of Health where a licensed engineer has made a percolation test and has designed a disposal system . The licensed engineer must furnish the plumbing inspector a design of the proposed disposal system prior to inspection by the inspector . " i�s� DEED &..M WrE U 7 J - 4 - Section 7 . That Sec . 8 . 1 . 1 of Chapter 8 of the Arkansas State Plumbing Code referred to above [ section 15 - 1 ] be amended by adding the following : " Rigid DWV plastic ,)pipe shall be supported at each floor level in such manner as to maintain alignment . Semi - flexible DKV piping shall be anchored to studs , or other rigid vertical support at intervals to maintain alignment . " Section 8 . That Sec . 8 . 1 . 2 of Chapter 8 of the Arkansas State Plumbing Code referred to above [ section 15 - 1 ] be amended to read as follows : " Sec . 8 . 1 . 2 - Plastic Pipe Supports Horizontal DWV rigid plastic pipe shall be supported by acceptable hangers , columns , or other supports at three ( 3 ) foot centers for pipe one and one - half ( 1 1 / 2 ) inches in diameter , or less , and at four ( 4 ) foot centers for pipe above one and one - half ( 1 1 / 2 ) inches in diameter . Horizontal DWV semi - rigid plastic pipe shall be supported 100 % of its length . " Section 9 . That Sec . 10 . 1 . 5 of Chapter 10 of the Arkansas State Plumbing Code referred to above [ section 15 - 1 ] be amended to read as follows : " Sec . 10 . 1 . 5 - Water Service Pipe (Materials ) - - - Cold water service piping shall be of case iron , type " K" or " L " copper tubing or galvanized pipe except when such service is under concrete , then such pipe shall be cast iron pipe , type " K" copper tubing and comply with Sections 3 . 8 i and 4 . 4 . 7 . 5 DEED 830 FAGE G94 The use of plastic water piping is prohibited , except in lawn sprinkler .--system and in water piping installations designed for the sole purpose of furnishing water on a temporary basis to building construction sites . When plastic water piping and / or any other approved piping material is used in lawn sprinkler systems , the following requirements shall be met : " ( a ) All plastic water piping must be approved by the testing laboratory or the National Sanitation Foundation for use in potable water systems and bear the NSF stamp of approval for use in such systems . (b ) An approved vacuum breaker shall be installed and shall be in conformity with the provisions of Sections 10 . 5 . 2 and 10 . 6 . 4 of the Arkansas State Plumbing Code . The vacuum breaker shall be installed in a location so that it will be protected against freezing , tampering and damage . Such location shall be approved by the plumbing inspector . " Section 10 . That Chapter .1.0 by thekAtkansas - Statea,Plumbing- Cod referred to above , jsection 15 - 1 ] is hereby amended by aiding a section to be numbered 10 . 5 . 5 which said section reads as follows : " 10 . 5 . 5 Commercial Industrial Building Protection Every commercial or industrial building hereafter erected or extensively remodeled that will house any type of manufacturing or commercial process where there could be a danger of backflow or backsiphonage of nonpotable water into the city water system must install an approved reduced pressure backflow preventer that is acceptable to the Arkansas State Health Department in the water distribution system between the water meter and the first water outlet , appliance or fixture in said building . " DEED 826 MUM - 6 - Section 11 . That the Arkansas State Plumbing, Code referred to above [ section 15 . 1 ] is hereby amended by adding a section to be numbered 10 . 5 . 6 which said section reads as follows : " 10 . 5 . 6 Anti - freeze Automatic Fire Sprinkling Systems Every automatic fire sprinkling system that is connected to the Fayetteville water distribution system which contains sections that contain anti - freeze solution shall have an approved reduce pressure backflow preventer that is acceptable to the Arkansas State Health Department installed in the sprinkling system ahead of such anti - freeze sections in such a way as to prevent the anti - freeze solution from entering the city water system . " Section 12 . That Sec . 11 . 1 . 2 of Chapter 11 of the Arkansas State Plumbing Code referred [ section 15 . .1 ] be amended as follows : " Sec . 11 . 1 . 2 Above Ground Piping Within Building - - - Soil and waste piping for a drainage system within a building shall be of cast iron , brass , copper pipe or type K , L . acceptable DWV plastic pipe , or DWV hard drawn copper tubing with the following exceptions : ( a ) That short horizontal branch arms of galvanized pipe will be permitted for waste piping above the floor within building . ( b ) That proper connection from cast iron soil pipe to cast iron drum traps may be made above ground within buildings with short all - thread galvanized pipe and drainage fittings . DEED �c�I ® PAfE .(fb)' - 7 - ( c ) Acceptable DWV plastic pipe may be used for soil and waste piping in one and/ or two family residential construction of three ( 3 ) stories , not exceeding thirty - six ( 36 ) feet in height . " Section 13 . That Sec . 11 . 1 . 3 of Chapter 11 of the Arkansas State Plumbing Code referred to above [ section 15 - 1 ] be amended to read as follows : " Sec . 11 . 1 . 3 - Underground Piping Within Buildings Underground drains within buildings shall be of cast iron soil pipe , extra heavy duty lead pipe , type K or L copper tubing , or acceptable DWV plastic pipe . " Section 14 . That Chapter 11 of the Arkansas State Plumbing Code referred to above [ section 15 - 1 ] is hereby amended by adding a section to be numbered 11 . 2 . 6 which said section reads as follows : Sec . 11 . 2 . 6 Bedding of Building Sewer Piping In Trenches . All building sewers shall be installed according to the manufacturers recommendations for the installation and bedding of the particular type of sewer pipe and only deviations from these recommen - dations by the administrative authority will be permitted . " Section 15 . That Sec . 12 . 1 . 2 of Chapter 12 of the Arkansas Plumbing Code referred to above [ section 15 - 1 ] be amended by adding the following : "Acceptable DWV plastic pipe may be used for vent piping in one and/ or two family residential construction of three ( 3 ) stories , not exceeding thirty - six ( 36 ) in height . " DEED 820 PAE6, 7 - 8 - Section 16 . That Sec . 12 . 1 . 3 of Chapter 12 of the Arkansas Plumbing Code referred to above [ section 15 - 1 ] be amended as follows : Sec . 12 . 1 . 3 - Underground Vent Piping Vent piping placed underground shall be cast iron soil pipe , type K or L copper tubing , extra heavy lead pipe , or acceptable DWV plastic pipe . " Section 17 . Saving Clause . Nothing in this ordinance or in the code hereby adopted shall be construed to affect any suit or proceeding now pending in any court , or any rights acquired , or liability , incurred , nor any cause or causes of action accrued or existing , under any act or ordinance repealed hereby . Nor shall any right or remedy of any character bellost , impaired or affected by this ordinance . Section 18 . Validity . The invalidity of any section or provision of this ordinance or of the code hereby adopted shall not invalidate other sections or provisions thereof . Section 19 . Inconsistent Ordinances Repealed . Ordinances or parts thereof in force at the time that this ordinance shall take effect and inconsistent herewith , are hereby repealed . Section 20 . Emergency Clause . Whereas it is of the utmost urgency that the City of Fayetteville , Arkansas have an up + to date Plumbers Code to protect the property and lives of the citizens of our city DEED Off ® Mf,E16 - 91- - therefor an Emergency is hereby declared to exist and this ordinance being necessary for the immediate protection of the public peace , health and safety shall take effect immediately on its passage and approval . Mat the Arkansas State Plumbing Code referred to above (section 15.1) is hereby amended by adding a section) to be numbered 105.6 which said sec- tion reads as follows: '10.5.6 Anti -freeze Automatic Fire Sprinkling Systems Every automatic fire sprinkling system that is connected to the Fayetteville water distribution vvs- ten which contains sections that Contain anti -freeze solution shall have an approved reduce pressure backflow presenter that -. is ac- ceptable to the Arkansas Stated Health Department installed In the sprinkling system ahead of such ant! -freeze sections in such a way as to prevent the antifreeze solu- tion from entering the city water system" section 12 That Sec. 11.1.2 of Chapter 11 of the Arkansas State Plumbing Code referred (section 15.1) be amended as follows. "Sec. 11.1.12 Above Ground Piping Within Building — soil and waste piping for a drain- age system within a building shall be of cast iron, brass, cop- per pipe or type X, L, acceptable DWV plastic pipe. or DWV herd drawn copper tubing with the fol- lowing exceptions: (a) That short horizontal branch arms of galvanized pipe will be permitted for waste piping above the floor within the building (b) That proper connection from cast iron soil pipe to cast Iron drum traps may be made above ground within buildings with I short all -thread galvanized pipe and drainage fittings. (C) Acceptable DWV plastic pipe may be used for soil and waste piping in one and/or two family residential construction of three (3) stories, not exceeding thirty-' six (36) feet in height.' Section 13. That Sec. 11.1.3 4 Chapter 11 of the Arkansas State Plumbing Code referred to above (section 1$-U be amended to tread as follows: "Sec 11.1.3 —Underground Piping With- in Buildings Underground drains wthin build- ings shall be of cast Iron soil pipe, extra heavy duty lead pipe, lope K or H copper tubing, or accepta- ble DWV plastic pipe." - Section 14. That Chapter 11 of the Arkansas Slate, Plumbing Code referred to above (sec- tion 15-1) Is hereby amended by adding a section to be numbered 11.2.6 which said section reads as follows: Sec. 11.16 Bedding of Building Sewer Piping In Trenches. All building sewers shall be installed according to the manufacturers recommendations for the installation and bedding of the Particular type) of sewer pipe and only deviations from these recommendations by the! administrative authority will be permitted." Section 15. That Sec. 12.1.3 of Chapter 12 of the Arkansas Plumbing rode referred to above (section 151) be amended as ful- I lows: Sec. 12.1.3 —Underground tint Piping, Vent piping placed underground'. shall be cast iron soil pipe, type K or L copper tubing, extra heavy lead plot, or acceptable DWV plas- tic pipe" Section 17. Saving Clause. Nothing in this ordinance Or In the code hereby adopted shall be construed to affect any suit or proceeding now pending In any court, or any rights ac- quired, or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance re- pealed hereby. Nor shall any right or I remedy of any character be lost, in,- paired or affected by this ordinance. Section 18. Validity. The Invalidity of any section or provi- sion of this ordinance or of the rode hereby adopted shall not invalidate oth- er sections or provisions thereof. Section 19. Inconsistent Ordinances Re- pealed. Ordinances or parts thereof In force at the time that this ordinance shall, take effect and inconsistent herewith, are hereby repealed. Section 20. Emergency Clause. Whereas It is of the utmost urgency that the City of Fayetteville, Arkansas have an up to date Plumbers Code to protect the property and lives of the citizens of our city therefor an Emer- gency is hereby declared to exist and this ordinance being necessary for the immediate protection of the public peace, health end safety shall tike effect Im- mediately on its passage and approval.
