AN ORDINANCE VACATING AND ABANDONING A POR`ILllb`NKOP f} ;li
AVENUE AND AN UNNAMED STREET LYING EAST OF HILL IAV'EMft "IN THE
CITY OF FAYETTEVILLE , ARKANSAS
WHEREAS , p petition was duly filed with the Board of Directors
of the City of Fayetteville , Arkansas on the 22nd day of February ,
1972 , asking the Board of Directors to vacate and abandon the
following portion of Hill Avenue and an unnamed street lying east
of Hill Avenue in the City of Fayetteville , Arkansas , to - wit :
A fifty ( SO ) foot street lying adjacent to and along
the West side of Lots 3 and 6 in Block One ( 1 ) , I . W .
Duncan ' s Addition to the City of Fayetteville , Arkansas ,
and lying adjacent to and East of Lots 1 through 7 in
Block Two ( 2 ) of O . W . Duncan ' s Addition to the City
of Fayetteville , Arkansas , and a fifty ( SO ) foot
street lying adjacent to and North of Lots 1 through
3 , inclusive , in Block One ( 1 ) of I . W . Duncan ' s
Addition to the City of Fayetteville , Arkansas .
WHEREAS , after due notice as required by law , the Board of
Directors has , at the time and place set forth in the notice ,
heard all persons desiring to be heard on the question and has
ascertained that the portion of the streets hereinabove described
have heretofore been dedicated to the public use as street ; have
not actually been used by the public for a period of many years ;
that all of the owners of the property adjoining and abutting
upon the streets to be vacated have consented to this abandonment ,
and that the public interest and welfare will not be adversely
affected by the abandonment of such streets .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . The City of Fayetteville , Arkansas , hereby releases ,
vacates , and abandons all of its rights , together with the rights of
the public generally in and to the portion of the street hereinabove
described , subject , however , to a twenty - five ( 25 ) foot sewer
easement being twelve and one - half ( 12 1 / 2 ) feet either side of
the sewer line as presently located .
Section 2 . This ordinance shall be in full force and effect
from and after its passage , approval and publication .
