FOR THE INSPECTION OF DWELLINGS AND PREMISES ; AND fi0'R' OTHfk% PURPOSES . BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . ADOPTION OF MINIMUM HOUSING CODE . There is hereby adopted by the Board of Directors of the City of Fayetteville , Arkansas , that certain health and housing standards known as the Southern Standard Housing Code , 1969 Edition of the Southern Building Code Congress , of which not less than three ( 3 ) copies have been and are now filed in the office of the Clerk of the City of Fayetteville , Arkansas , and the same are hereby adopted and incodporated as fully as if set out at length herein , and from the date on which this ordinance shall take effect , the provisions thereof shall be controlling on all dwellings and premises within the corporate limits of Fayetteville , Arkansas . Section 2 . ESTABLISHMENT OF A HOUSING BOARD OF APPEALS . There is hereby created a Board of Housing Appeals which shall consist of three members appointed by the Mayor and subject to confirmation by the Board of Directors . This Board shall act by a majority vote of the members present . Two members shall be necessary to constitute a quorum . Said Board shall have the power and be required to hold public hearings in deciding appeals where it is alleged there is an error in law or fact in any order or decision of the Housing Enforcing Official in the enforcement of this ordinance . Section 3 . AMENDMENTS TO THE CODE HEREBY ADOPTED . The Code hereby adopted is amended and changed in the following respects : Section 103 . 1 is amended to read as follows : " § 103 . 1 - RIGHT OF ENTRY The Building Official shall enforce the provisions of this Code , and he , or his duly authorized representative DEED 824 PAGE 595 DA EGCTL 1 2 1978 REEL 17 �1 - 2 - upon presentation of proper identification to the owner , agent , or tenant in charge of such property , may enter any building , structure , dwelling , apart - ment , apartment house , or premises , during all reasonable hours , except in cases of emergency where extremerhhzards are known to exist which may involve the potential loss of life or severe property damage in which case the above limitations shall not apply . The occupant of a dwelling or dwelling unit shall give the owner thereof , or his agent or employee , access to any part of such dwelling or dwelling unit , or its premises , at all reasonable times for the pur - pose of making such repairs or alterations as are necessary to effect compliance with the provisions of this chapter or with any lawful rule or regulation adopted or any lawful order issued pursuant to the provisions of this chapter . " Section 201 . 2 is hereby amended by the addition of the following material : " OCCUPANT shall mean any person , over one year of age , living , sleeping , cooking , or eating in , or having actual possession of , a dwelling unit or rooming unit . " Section 304 . 16 is hereby amended by the addition of the following material : " § 304 . 16 - INTERIOR FLOOR , WALLS , AND CEILINGS Every floor , interior wall and ceiling shall be substantially rodent proof ; shall be kept in sound condition and good repair ; and shall be safe to use and capable of supporting the load which , normal use may cause to be placed thereon . Every water closet compartment floor surface and bathroom floor surface shall be constructed and maintained so as to be reasonably impervious to water and so as to permit such floor to be easily kept in a clean and sanitary condition . " DEED 824 PACE 59.6 - 3 - Section 4 . SAVING CLAUSE . Nothing in this ordinance or in the code hereby adopted shall be construed to affect any suit or proceeding now pend - ing in any court , or any rights acquired , or liability in - curred , nor any cause or causes of action accrued or existing , under any act or ordinance repealed hereby . Nor shall any right or remedy of any character be lost , impaired or affected by this ordinance . Section S . VALIDITY The invalidity of any section or provision of this ordinance or of the code hereby adopted shall not invalidate other sections or provisions thereof . Section 6 . INCONSISTENT ORDINANCES REPEALED . Ordinances or parts thereof in force at the time that this ordinance shall take effect and inconsistent herewith , are hereby repealed . Section 7 . EMERGENCY CLAUSE . Whereas , it is of the utmost urgency that the City of Fayetteville , Arkansas , have an up to date Housing Code to protect the property and lives of the citizens of our city therefor an Emergency is hereby declared to exist and this ordinance being necessary for the immediate protection of the public peace , health and safety shall take effect immediately on its passage and approval . �/ PASSED AND APPROVED this /A day of , 197,.
