BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : 1 . .- Section 1 . That Section 6 - 87 . 1 of the Code of Ordinances , J City of Fayetteville , Arkansas , is hereby amended to read as follows : v " 2204 . 3 - BUILDING OFFICIAL SHALL REJECT WHEN The Building Official shall refuse to issue a moving permit if he finds : ( a ) That any application requirement or any fee , bond , or deposit requirement has not been ful - filled ; or (b ) That the building is so constructed or in such condition as to be dangerous ; or (c ) That the building is infested with pests or insanitary ; or (d ) If the building is a dwelling or habitation , that it is unfit for human habitation as defined by the Housing Code of the City ; or ( e ) That the building to be moved is so dilapidated , defective , unsightly or in such a condition of deterioration or disrepair that its relocation at the proposed site would cause appreciable harm to or be materially detrimental to the property or improve - ments in the district within a radius of one thousand ( 1 , 000 ) feet from the proposed site ; or ( f ) That zoning or other ordinances would be violated by the building at the proposed site ; or ( g ) That the building is of a type prohibited at the proposed location by any ordinance of the City ; or (h ) That the moving of the building would cause unreasonable damage to the trees , plants and shrubs on and along the public streets ; or OE ED 822 PACE 869 AOCTLD1 DTE DATE CT t 2 1578 REEL. 2 ( i ) That the applicant ' s equipment is unsafe and that persons and or property would be endangered by its use . " Section 2 . That the Code of Ordinances , City of Fayette - ville , Arkansas , is hereby amended by adding a section to be numbered Sec . 6 - 87 . 2 , which said section reads as follows : "TERMS AND CONDITIONS OF PERMIT . When a moving permit is granted , Building Officials shall impose such terms and conditions as may deemed reasonable , . including , but not limited to, the public streets , or other public property in the City on , over , or through which building or structures shall be moved , and the requirements of changes , alterations , additions , or repairs to be made to or upon the building or structure , to the end that the relocation thereof will not be materially detrimental or injurious to public safety , public welfare or to the property and improvements , or either , in the district to which it is to be moved . Such terms and conditions shall be written upon the permit or appended in writing thereto . " Section 3 . That the section of the Code of Ordinances , City of Fayetteville , Arkansas , presently designated Sec . 6 - 87 . 1 is hereby renumbered and designated as Sec . 6 - 87 . 3 of the Code of Ordinances , City of Fayetteville , Arkansas . Section 4 . That all ordinances and parts of ordinances in conflict herewith are hereby repealed and this ordinance shall be in full force and effect from and after its passage , approval and publication .
