I • , 'il OCT t2 Pp 4•• 32 ORDINANCE N0 . /8a6 �,Aswmc,"01'���N1Y K'',,OTTLCL7��( R AN ORDINANCE VACATING AND ABANDONING A PO' WON OF JON STREET LOCATED IN STUBBLEFIELD ADDITION OF THE CITY OF FAYETTEVILLE , ARKANSAS . WHEREAS , a petition was duly filed with the Board of Directors of the City of Fayetteville , Arkansas on August 31 , 1971 asking the Board of Directors to vacate and abandon all that portion of Jon Street lying West of Elizabeth Avenue in Block 5 of the Stubblefield Addition , said addition now appearing of record in Plat Book at page 414 , in the office of the Circuit Clerk and Ex - Officio Recorder of Washington County , Arkansas . WHEREAS , after due notice as required by law , the Board has , at the time and place mentioned in the notice , heard all persons desiring to be heard on the question and has ascertained that the street , hereinbefore described , has heretofore been dedicated to the public use as a street hereinbefore described ; has not been actually used by the public generally for a period of at least five years sub - sequent to the filing of the plat ; that all the owners of the property abutting the portion of the street to be vacated have filed with the Board their written consent to such abandonment ; and that public interest and welfare will not be adversely affected by the abandonment of such street . NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : Section 1 . The City of Fayetteville , Arkansas , hereby releases , vacates and abandons all its rights , together with the rights of the public generally , in and to the street designated as follows : The West 180 feet of Jon Street more particularly described as : The extension of Jon Street from its intersection with the West line of Elizabeth Avenue , 180 feet West to the West line of Block 5 of the Final Revised Plat of Stubblefield Addition to the City as per plat of said Addition on file in the office of the Circuit Clerk and Ex - Officio Recorder for Washington County , Arkansas . A copy of the Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of the County and recorded in the Deed Records . Section 3 .
