AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE NO . 11672
AS AMENDED BY ORDINANCE N0 , 12232 1295 , and 1583 , AND MORE
PARTICULARLY INCREASING THE ANNUAL FRANCHISE TAX OF THE
SOUTHWESTERN BELL TELEPHONE COMPANY .
WHEREAS , the Board of Directors of the City of
Fayetteville , Arkansas , finds it necessary to increase
the annual franchise tax of the Southwestern Bell Telephone
Company ,
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
Section 1 . That Section 2 of Ordinance No . 1167 , as
amended by Ordinances No . 12232 1295 , and 1583 , is hereby
amended to read as follows , to - wit :
" Section 2 . ( a ) The Telephone Company shall pay to the
City on or before March 1 , 1971 , for the period January 1 to
December 31 , 1971 , inclusive , and thereafter for like periods
on or before each March 1 an amount determined by multiplying
the number of telephones within the corporate limits of the
City as of the last day of the preceding year by the sum of
( $ 1 . 00 ) .
(b ) In addition , the Telephone Company
shall pay to the City an amount determined by subtracting
the amount determined in subsection ( a ) above from Thirty
Seven Thousand Five Hundred Dollars ( $ 37 , 500 . 00 ) . The
result determined in this subsection (b ) shall be paid in
four equal installments annually , the first installment
due and payable April 1 , 1971 , second and subsequent
installments due quarterly thereafter . "
Section 2 . That all ordinances or parts of Ordinances
in conflict herewith are hereby repealed and this Ordinance
shall be in full force and effect from and after its passage ,
approval and publication .
