ORDINANCE N0 , S
AN ORDINANCE AUTHORIZING THE CITY MANAGER OR HIS DULY AUTHORIZED REPRESENTATIVE
TO PROHIBIT USES OF WATER FROM THE CITY WATER SUPPLY SYSTEM NOT ESSENTIAL TO
THE PUBLIC WELL-BEING ; AUTHORIZING THE CITY TO TERMINATE WATER SERVICE FOR
VIOLATION ; PRESCRIBING PENALTIES FOR THE VIOLATION OF ITS PROVISIONS ; AND
DECLARING THE PRESENCE OF AN EMERGENCY
NOW, THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE
Section 1 . For the purpose of this Ordinance the following terms , phrases ,
words , and their derivations shall have the meaning given herein . When not
inconsistent with the context , words used in the present tense include the future ,
words in the plural number include the singular number , and words in the
singular number include the plural number . The word "shall" is always man-
datory and not merely directory .
(a) "City" is the City of Fayetteville , Arkansas .
(b) "Person is any person , firm , partnership , association ,
corporation , company or organization of any kind .
(c) "Water" is water from the City Water Supply System.
Section 2 . The provisions of this Ordinance shall apply to all persons
using water both in and outside the City .
Section 3 . The City Manager or his duly authorized representative is
hereby authorized to prohibit the use and withdrawal of water by any person when
there is an impending shortage of water for any one or more of the following
purposes :
(a) Watering Yards . The sprinkling , watering or irrigation
of lawns , grass , or ground cover .
(b) Watering Other Vegetation . The sprinkling , watering
or irrigation of shrubbery , trees , plants , vines , gardens , vegetables ,
flowers , or any other vegetation .
(c) Washing Mobile Equipment . The washing of automobiles , trucks ,
trailers , trailer-houses , railroad cars , or other types of mobile
equipment .
(d) Cleaning Outdoor Surfaces . The washing of sidewalks ,
driveways , filling station aprons , porches and other outdoor
surfaces .
(e) Cleaning Buildings . The washing of the outside of
dwellings ; the washing of the inside and outside of office buildings .
( f) Ornamental Fountains . The operation of any ornamental
fountain or other structure making a similar use of water .
(g) Swimming Pools . Swimming and wading pools not employing
a filter and recirculating system.

Section 4 . Notice of such prohibition shall be published once in
a newspaper of general circulation in the City of Fayetteville , Arkansas .
Section 5 . The County Sanitarian shall have the authority to permit
a reasonable use of water in any case necessary to maintain adequate
health and sanitation standards .
Section 6 . The Water and Sewer Superintendent shall have available
and furnish all records necessary to determine the usages of water
restricted under the terms of this Ordinance .
Section 7 . Every police officerof the City shall , in connection
with his duties imposed by law , diligently enforce the provisions of
this Ordinance .
Section 8 . The City Manager or his duly authorized representative
shall have the authority to enforce the provisions of this Ordinance by
the discontinuance of water service in event of violation hereof .
Section 9 . The use or withdrawal of water by any person when pro-
hibited under the terms of this Ordinance is declared to be a misdemeanor
punishable by a fine of not more than twenty-five dollars ( $25 . 00) ; pro-
vided , however , that if the violation of this Ordinance is continuous in
respect to time , the penalty for the continuation thereof shall not exceed
fifteen dollars ( $ 15 . 00) for each day that the same is continued .
Section 10 , All Ordinances and all parts of ordinances in conflict
herewith are hereby repealed .
Section 11 . This Ordinance is passed as an emergency measure , and
the Board of Directors does , by the vote by which this Ordinance is passed ,
hereby declare that an emergency exists , which makes it imperative that
this Ordinance should become effective forthwith in order that the public
health , welfare and safety might most effectively be provided for .
