Home My WebLink AboutOrdinance 1749 rights of the public generally , subject to a reserved utility easement , in and to the alley described as follows , to-wit : An area fourteen ( 14 ) feet in width and one hundred eighty- nine ( 189 ) in length , being the East 189 feet of the East-West alley lying immediately South of Dickson Street and originally platted as an alley in Block One ( 1 ) of J . H . McIlroy ' s University Subdivision to the City of Fayetteville , Washington County , Arkansas . SECTION 2 . Said utility easement shall be for the benefit of the City of Fayetteville , Arkansas , provided , however , that upon the abandonment by the City of Fayetteville , said land shall become the property of the abutting property owners . SECTION 3 . That said portion of said alley not reserved for utility easements shall become the property of the abutting property owners . SECTION 4 . A copy of this Ordinance , duly certified by the City Clerk , shall be filed in the Office of the Recorder of the County and recorded in the deed records of the County . SECTION 5 . WHEREAS , a Petition was duly filed with the Boa rdA. �4pf Direc- tors of the City of Fayetteville , Arkansas , on the day of 1970 , asking the Board of Directors to vacate and abandon a certain alley in the City of Fayetteville , Arkansas , described as follows : The East-West alley lying between Lots 1- 15 on the North , and Lots 16 and 37 on the South , in Block One ( 1 ) , J . H .
