AN ORDINANCE AUTHORIZING THE COUNTY SANITARIAN TO REQUIRE
SEWER CONNECTION ; AND PROVIDING PENALTIES FOR THE VIOLATION OF
ITS PROVISIONS .
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section 1 . The County Sanitarian is hereby authorized and
directed , whenever in his opinion , the public health will be
promoted thereby , to order any one or more property owners near
or adjacent .. to any sanitary sewer , to construct upon their
property sanitary sewers leading from some point or place on
their premises to the sanitary sewer of the City , for the purpose
of conducting sewage and liquid waste into the City ' s sewage
system . In the order so issued , as aforesaid , to construct the
sewers aforesaid , for the purposes aforesaid , the time within
which the same is to be completed , the nature and character of
the materials to be used in the construction thereof , and the
place of tapping the sewers of the City shall be designated , as well
as the manner of doing the same .
Section 2 . Nothing in this ordinance shall be so construed
as to authorize the County Sanitarian to order or compel the
building of a sewer by one property owner over the property of
another , or for a greater distance from his property through or
into any street or alley than 100 feet , to a place where a
connection can be made with a sewer .
Section 3 . If the owner of said property shall fail ,
neglect , or refuse to make this sewer as therein ordered , within
the time in said order prescribed , unless further time be granted
for the completion of the same , it shall be the duty of the
Water and Sewer Superintendent of the City of Fayetteville , Arkansas
to order discontinuance of water service by the City of Fayetteville ,
Arkansas to the property where the owner fails , neglects or refuses
to make the sewer connection as ordered .
Section 4 . It is declared a misdemeanor for any person to
fail , neglect or refuse to connect with or tap the sewers of
the City of Fayetteville , Arkansas within the time prescribed
by an order of the County , Sanitarian . Any sewer public or private
made under the provisions of this Act , and any persons so offending
on conviction thereof shall be punished by a fine in the sum of
$ 25 . 00 for the first offense , and shall be punished by a fine of
$ 15 . 00 for each day that such violation continues .
