AN ORDINANCE TO VACATE AND ABANDON A CERTAIN ALLEY IN THE CITY OF
FAYETTEVILLE , ARKANSAS .
WHEREAS , a petition was duly filed with the City Clerk of the
City of Fayetteville , Arkansas , on the 17th day of September , 1969 ,
asking that the Board of Directors of the City of Fayetteville va -
cate and abandon a certain alley in the City of Fayetteville , de -
scribed as follows :
A 15 foot alley being a part of the Oak Park Place
Addition to the City of Fayetteville , Arkansas , and
described as beginning at California Boulevard and
extending Northwesterly to the platted intersection
of West Maryland Street and West Center Street inter -
section and bounded on the Northeast by Lot 124 and
Lot 109 and bounded on the Southwest by Lot 123 and
Lot 110 .
WHEREAS , it appears from the petition that the petitioners are
C . Dwight Dodson , Nancy Sue Dodson , Merwyn G . Bridenstine , Freda L .
Bridenstine , and P . C . Boatright , are the owners of all the lots
abutting said alley .
WHEREAS , said petition was presented to the City Planning Com -
mission at its regular meeting on October 21 , 1969 , and said Planning
Commission has recommended to the Board of Directors of the City of
Fayetteville , Arkansas , that the Board of Directors enact an ordinance
to vacate and abandon said alley .
WHEREAS , it appears that said alley has not been actually used by
the public generally for a period of at least five ( 5 ) years subse -
quent to the establishment of the alley ; that all of the owners of the
property abutting upon the portion of the alley to be vacated have
filed with the Board of Directors their written consent to such aband -
onment ; and that public interest and welfare will not be adversly
affected by the abandonment of such alley .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1 , The City of Fayetteville , Arkansas , hereby releases ,
vacates and abandons all its rights , together with the rights of the
public generally in and to the said alley described aforesaid .
SECTION 2 . A copy of this ordinance duly certified by the City
Clerk shall be filed in the Office of the Recorder of the County and
recorded in the Deed Records of the County .

SECTION 3 . That all ordinances or parts of ordinances in
conflict herewith are hereby repealed , and this ordinance shall
be in full force and effect from and after its passage , approval ,
and publication .
