WHEREAS , a public hearing was held before the Planning Commis -
sion of the City of Fayetteville , Arkansas , on October 21st , 1969 ,
on the petition of Charles C . Shepherd and Harvey D . Luttrell ,
requesting that said Planning Commission recommend to the Board of
Directors of the City of Fayetteville , Arkansas , that the Board of
Directors enact . an ordinance rezoning the following described prop -
erty , presently zoned R - 2 , Two Family Residential District , to R - 3 ,
Multi - Family Residential District , to - wit :
A part of the Southwest quarter ( SW 1 / 4 ) , of the Northwest
quarter ( NW 1 / 4 ) , Section 9 , Township 16 North , Range 30 West
of the Fifth Principal Meridian , Fayetteville , Arkansas . More
particularly described as follows :
Beginning at a point 780 . 0 feet North and 420 . 0 feet West
of the Southeast corner of said 40 acre tract ; thence North
300 . 0 feet ; thence West 241 . 0 feet ; thence South 300. 0 feet ;
thence East 241 . 0 feet to the point of beginning and containing
1 . 66 acres , more or less .
and ,
WHEREAS , notice of said public hearing , setting forth the date ,
time , place and purposes of said hearing and location of the property
was published in the Northwest Arkansas Times , a newspaper of general
circulation in said City , more than 15 days prior to said public
hearing , and
WHEREAS , following said public hearing , said Planning Comm -
ission certified to the Board of Directors of the City of Fayetteville ,
its recommendation that an ordinance be adopted rezoning the above -
described property , presently zoned R - 2 , Family Residential District ,
to R - 3 ; Multi - Family Residential District .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1 . That the above - described property , which is present -
ly zoned R - 2 , Family Residential District , be and the same is hereby
rezoned to R - 3 , Multi - Family Residential District .
