Not WHEREAS , a petition wasd0'lyl��f�iiTediFv)ith the City Clerk of the City of Fayetteville , Arkansan, on the 1st day of April , 1969 , asking the Board of Directors of the City of Fayetteville to vacate and abandon certain alleys described as follows , to - wit : All that portion of the North - South alley in Block 16 , Original Town of Fayetteville , Arkansas , lying between and adjacent to Lots 12 , 132 14 and 15 on the one hand and Lots 1 , 22 3 and 4 on the other hand . All that portion of the East - West alley in Block 16 , Original Town of Fayetteville , Arkansas , lying east of North - South line ( the center line of the North - South alley in Block 16 ) which line is parallel to and six feet west of the West line of Lot 4 , Block 16 , Original Town of Fayetteville , Arkansas . WHEREAS , by Resolution PC - 39 - 69 , adopted August 19 , 1969 , the Planning Commission of the City of Fayetteville has recommended to the Board of Directors that the Board of Directors enact an ordinance vacating and abandoning the above described public alleys . WHEREAS , after due notices as required by law , the Board of Directors has , at the time and place mentioned in the notice , heard all persons desiring to be heard on the question and has ascertained that the two public alleys , hereinbefore described , have heretofore been dedicated to the public use as alleys , have not been actually used by the public generally for a period of at least five years ; that all of the owners of the property abutting upon the alleys to be vacated have filed with the Clerk their written consent to such abandonment , and that public interest and welfare will not be adversely affected by the abandonment of such alley . NOW , THEREFORE , BE IT ORDAINED BY .THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : SECTION 1 . That the City of Fayetteville , Arkansas , hereby releases , vacates , and abandons all its rights , together with the rights of the public generally , in and to the two alleys described above .
