ORDINANCE NO . /
AN ORDINANCE AMENDING• ZONING ORDINANCE NO , 1239 , AND REVISED ZONING
DISTRICT MAP OF FAYETTEVILLE , ARKANSAS , APPROVED MAY 282 19622 AS
AMENDED , TO REZONE CERTAIN REAL ESTATE FROM R -IB , SINGLE FAMILY
RESIDENTIAL DISTRICT TO R - 3 ; MULTI - FAMILY RESIDENTIAL DISTRICT .
WHEREAS , a public hearing was held before the Planning Commission
of the City of Fayetteville , Arkansas , on July 15 , 1969 , on the petition
of Jerry D . Sweetser and Sharon J . Sweetser , requesting that said Plan -
ning Commission recommend to the Board of Directors of the City of
Fayetteville , Arkansas , that the Board of Directors enact an ordinance
rezoning the following described property , presently zoned R - 1B , Single
Family Residential District to R - 3 , Multi - Family Residential District ,
to - wit :
350 feet of equal and uniform width off of the south
side of the followinland , to - wit : Part of the South -
east Quarter ( SE 1 / 4q} of the Northwest Quarter ( NW 1 /-4 )
of Section 9 , Township 16 North , Range 30 East , of the
5th P . M . , the same being more particularly described as
follows , to - wit : Beginning at a stone at the Southeast
corner of the said 40 acre tract and running thence
North 80 rods , thence West .12 1 / 5 rods , thence South
20 1 / 2 degrees West 34 3 / 5 rods , thence East 100 feet ,
thence South 16 1 / 2 degrees West 45 rods , more or less ,
to the South line of said 40 acre tract and thence East
to the place of beginning , containing 9 . 7 acres , more or
less , LESS AND EXCEPT A strip of land 30 feet wide of equal and
and uniform width off of the South end thereof for public
road .
and ,
WHEREAS , notice of said public hearing , setting forth the date ,
time , place and purposes of said hearing and location of the property
was published in the northwest Arkansas Times , a newspaper of general
circulation in said City , more than 15 days prior to said public
hearing , and
WHEREAS , following said public hearing , said Planning Commission
certified to the Board of Directors of the City of Fayetteville , its
recommendation that an ordinance be adopted rezoning the above - describ -
ed property , presently zoned R'- 1B , Single Family Residential District
to R - 3 ; Multi - Family Residential District .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE, ARKANSAS :
SECTION 1 . That the above - described property , which is present - . Tl
