3AN ORDINANCE AMENDING SECTION 4 - 24. OF THE CODE OF ORDINANCES , CITY
OF FAYETTEVILLE , ARKANSAS , TO INCREASE DOG IMPOUNDMENT FEES .
Be it ordained by the Board of Directors of the City of
Fayetteville , Arkansas :
SECTION 1 , That Section 4 - 24 of the Code of Ordinances ,
City of Fayetteville , Arkansas , is hereby amended to read as
follows :
After the expiration of five ( 5 ) days after any dog has been
placed in the animal shelter , as provided for in Section 4 - 22 , it
shall be the duty of the animal control officer to kill such dog
and dispose of the carcass ; provided that , the owner of such dog
may , within five ( 5 ) days and at any time before the dog is
killed , redeem or claim such dog and have the same delivered to
him , upon the payment of the costs of such taking up , which is
ascertained to be Two dollars ( $ 2 . 00 ) impoundment fee for the
first pickup within a calendar year and Four dollars ( $ 4 . 00 )
for each subsequent pickup of the same dog within a calendar
year , plus Two dollars and fifty cents ( $ 2 . 50 ) for each day
such dog has been in the animal shelter , together with the
tax on such dog , if the same has not been paid , and the costs of
vaccinating any unvaccinated dog . Such costs shall be paid to
the animal control officer who shall remit all such payments
to the city controller as general fund revenues . For the purpose
of this section , the day of taking up any dog shall be counted as
the first day of the five - day period herein provided for .
SECTION 2 . That all ordinances or parts of ordinances in
conflict herewith are hereby repealed .
SECTION 3 . The fees previously provided for by this section
have not been sufficient to deter violations of provisions of the
Fayetteville Code of Ordinances prohibiting dogs from running at
large at certain specified times . An emergency is therefore
declared and this ordinance being necessary for the preservation
of the public peace , health and safety shall be in full force and
effect from and after its passage .
