AN ORDINANCE VACATING AND ABANDONING A PORTION OF KNOX DRIVE IN A . M .
IRWIN ADDITION TO THE CITY OF FAYETTEVILLE , ARKMSAS;.- � 01;; 10 : 55
WHEREAS , a petition was duly filed with th'euBoard q$ Directors
of the City of Fayetteville , Arkansas , on the 15th ' c3ay : `of. July , 1968 ,
asking the Board of Directors to vacate and abandonithe� .following portion
of Knox Drive , located in A . M . Irwin Addition to thel6ity of Fayette -
ville , Arkansas , to -wit :
A parcel of land situated in theN 1/2 of the NW 1/ 4
of Section 10 T- 16 -N , R- 30 -W , being more particularly
described as follows : Beginning at the SE corner
NE 1/4 , NW 1/ 4 Sec . 10 T- 16 -N , R- 30 -W ; thence W 50
feet ; thence N 225 feet ; thence E . 50 feet ; thence
S . 225 feet to the point of beginning , and situated
in the City of Fayetteville , Washington County , Ark -
ansas .
WHEREAS , after due notice as required by law , the Board of
Directors has , at the time and place set forth in the notice , heard all
persons desiring to be heard on the question and has ascertained that the
portion of the street hereinabove described has heretofore been dedicated
to the public use as a street ; has not actually been used by the public
subsequent to the filing of the plat ; that all the owners of the property
adjoining and abutting upon the street to be vacated have consented to
the abandonment , and that public interest and welfare will not be adverse -
ly affected by the abandonment of such street .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1 , The City of Fayetteville , Arkansas , hereby releases ,
vacates and abandons all its rights , together with the rights of the
public generally in and to the above described portion of Knox Drive
in the A . M . Irwin Addition to the City of ,Fayetteville , Arkansas , with-
out reservation . As a condition , however , to the closing of the above
described portion of Knox Drive , the City shall be held free and harm-
less from liability as to any claims of the abutting owners by reason
of this closing , vacation and abandonment , or any claims by any utili -
ties .
SECTION 2 . A copy of the Ordinance duly certified by the City
Clerk shall be filed in the Office of the Recorder of the County and
recorded in the Deed Records of the County ,
SECTION 3 , This Ordinance shall be in full force and effect
from and after its passage , approval and publication .
