AN ORDINANCE AMENDING ZONING ORDINANCE NO , 1239 , ANd'1A=iT$UPOZO1;;NG DIS -
TRICT MAP OF FAYETTEVILLE , ARKANSAS , APPROVED MAY 28 „ 6N12q^t,STQ REZONE
CERTAIN REAL ESTATE FROM 0- 1 OPEN LAND DISTRICT , TO ' C.' . .2, 1�LO9OUGHFARE
COMMERCIAL DISTRICT .
WHEREAS , A public hearing was held before the Planning Commis -
sion of the City of Fayetteville , on Tuesday , March 26 , 1968 , on the peti -
tion of J . W . Eoff and Marie Eoff , requesting that said Planning Commis -
sion recommend to the Board of Directors of the City of Fayetteville , Ark-
ansas , that the Board of Directors enact an ordinance rezoning the fol-
lowing described property , presently zoned 0- 1 Open Land District , to C-2
Thoroughfare Commercial District , to-wit :
A part of the NW 1/4 , NE 1/ 4 of Sec . 28 , T- 16 -N ,
described as : Beginning at a point which is 367 . 66
feet West of the NE corner of said 40 acre tract ,
and running thence South 10027 ' West with the middle
of the ditch or branch 201 feet to the center of a
20 foot roadway , thence North 78 1/20 West with the
center line of said roadway to the center line of
U . S . Highway 71 , thence North 12022 ' East with the
center line of said Highway 7 1/2 rods or tb the
North line of said forty acre tract , thence East
484 . 34 feet to the beginning point , containing
1 . 76 acres , more or less , subject to an easement
over and upon the South 10 feet of the above describ-
ed tract , which together with a 10 foot strip lying
South of said tract for use as a roadway extending
from the Southeast corner of said above described
tract to the center line of U . S . Highway 71 , less
and except the following , to-wit : Part of the NW 1/ 4
of the NE 1/4 of Section 28 , T- 16 -N , R- 30 -W , des -
cribed as beginning at a point 350 feet East of the
center line of U . S . Highway 71 and 818 feet East of
the Northwest corner of said 40 acre tract , and
running thence East 65 feet for a beginning point
for the land herein conveyed , thence East 69 . 3 feet ,
thence South 9 ° 30 ' West 189 feet , thence North 780
30 ' West 74 feet , thence North 11030 ' East 176 . 4
feet to the point of beginning .
and
WHEREAS , notice of said public hearing , setting forth the date ,
time , place and purposes of said hearing and location of property was
publiched in the Northwest Arkansas Times , a newspaper of general circu-
lation in said city , more than 15 days prior to said public hearing , and
WHEREAS , following said public hearing , said Planning Commission
certified to the Board of Directors of the City of Fayetteville , Arkansas ,
its recommendation that an ordinance be adopted rezoning the above -describ-
ed property , presently zoned 0- 1 Open Land District to C-2 Thoroughfare
Commercial District .

NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1 . That the above-described property , which is pre-
sently zoned 0- 1 Open Land District , be and the same is hereby rezoned
to C- 2 Thoroughfare Commercial District .
SECTION 2 . That all ordinances or parts of ordinances in con-
flict herewith are hereby repealed , and this ordinance shall be in full
force and effect from and after its passage , approval and publication .
