AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER
INTO AN AGREEMENT BY AND BETWEEN THE CITY OF SPRINGDALE , ARKANSAS AND THE
CITY OF FAYETTEVILLE , ARKANSAS ,
WHEREAS , The City of Springdale , Arkansas , through its Sewer Depart-
ment has provided City Sewer services to the City of Johnson , and
WHEREAS , to provide the greatest utility said sewer line was extend-
ed through a portion of lands lying within the Corporate Limits of the
City of Fayetteville , Arkansas , so as to serve lands lying in the South
part of the City of Springdale , Arkansas , and
WHEREAS , an agreement should be entered into by and between the City
of Springdale and the City of Fayetteville to provide for sewer service
to residents of the City of Fayetteville ; to provide for the collection
of service charges ; fix responsibility for operation and maintenance of
said sewer lines ; and for other purposes .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF FAYETTEVILLE:; ARKANSAS :
SECTION 1 : That the Mayor and City Clerk of the City of Fayetteville ,
Arkansas , be and they are hereby authorized and directed to execute that
certain agreement by and between the City of Springdale , Arkansas and the
City of Fayetteville , Arkansas , a copy of which is attached hereto and
made a part hereof .
That the City Manager be and he is hereby further authorized and dir-
ected to do such other and further acts as may be required to carry out
the spirit and intent of said agreement .
SECTION 2 . That as certain residents of the City of Fayetteville
are urgently needing to receive sanitary sewer service under the provisions
of said agreement , an emergency is declared to exist , and this ordinance
being necessary for the preservation of the public health and safety and
welfare , same shall be in full force and effect from and after its passage
and approval .
