AN ORDINANCE AMENDING THE FAYETTEVILLE CODE OF ORDINANCES TO PROVIDE FOR THE COLLECTION OF FEES FOR CRIMINAL PROSECUTIONS TRIED BY THE CITY ATTORNEY , AND FOR RELATED PURPOSES . WHEREAS , by Act 431 of 1967 , Acts of Arkansas , the General Assembly has authorized cities of the first class to provide by Ordinance for the assessment of fees for all prosecutions tried by the City , Attorney for violations of Ordinances of the City and for all prosecutions tried by the City Attorney for viola- tions of state laws committed within the corporate limits of said cities , such fees to be the same fees as are allowed Pro- secuting Attorneys in the State in all criminal cases , and WHEREAS , Act 431 further provides that in cities of the first class , where the City Attorney is paid a salary , the City may collect said fees and apply the same as the governing body may direct . NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE , ARKANSAS : SECTION 1 . That the Code of Ordinances , City of Fayetteville , Arkansas , is hereby amended by adding a section to be numbered Section 14- 7 , which section shall read as follows : Sec . 14 - 7 -Fees in Prosecutions Tried by City Attorneya- ( a) For all prosecutions tried by the City Attorney for violations of Ordinances of the City and for all prosecu- tions tried by the City Attorney for violations of State laws committed within the corporate limits of the City , resulting in conviction , the defendants shall be taxed the same fees as are allowed prosecuting attorneys in this state in all criminal cases . ( b ) All fees collected under this section whether the case be tried in the Municipal Court or on appeal to the Circuit Court , or Supreme Court , shall be paid over to the City Treasurer for application as the Board of Directors may direct . SECTION 2 . That this Ordinance shall be in full force and effect from and after its passage , approval and publication . PASSED AND APPROVED thisZjday of , 1967 .
