AN ORDINANCE AMENDING SECTIONS 6 -75 AND 6- 76 OF THE FAYETTEVILLE
CODE OF ORDINANCES , TO PERMIT MOVEMENT OF CERTAIN METAL STRUC-
TURES INTO THE FIRE LIMITS , AND TO PERMIT ERECTION OF,/ OR ADDI -
TIONS TOJ CERTAIN WOOD FRAME OR MASONRY VENEERED RESIDENCES AND
THE USE OF CERTAIN NON -COMBUSTIBLE WALLS OR PANELS WITHIN THE
FIRE LIMITS , AND TO DELETE AND MODIFY CERTAIN EXCEPTIONS TO RE-
STRICTIONS ON MOVEMENT OF STRUCTURES INTO] AND USE OFj CERTAIN
STRUCTURES IN THE FIRE LIMITS .
WHEREAS , by Ordinance No . 1120 of December 17 , 1956 , the
1955 Edition of the National Building Code was adopted by refer-
ence , subject to certain amendments to said Code also contained
in Ordinance No . 1120 . That Ordinance 1120 , including the
amendments to said Code , now appear in codified form as Sections
6 -34 -6 -91 of the Fayetteville Code of Ordinances , and
WHEREAS , it now appears that said Building Code , as amended ,
is unduly restrictive as it relates to the movement of certain
metal structures into the fire limits , the erection or addition
to certain wood frame and masonry veneered residences within the
fire limits , and the use of certain non- conbustible wall or pan-
els within the fire limits ; and it now appears that certain
amendments to said Code pertaining to the movement of residential
garages into the fire limits and the construction of certain
structures in the fire limits are no longer desirable and
should be deleted; and the Building Inspector has recommended
the amendment of the Building Code to affect these changes .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1 . That Section 6 - 75 of the Fayetteville Code of
Ordinances be amended by deleting the present language of said
Section and substituting the following :
Sec . 6- 75 . Section 400 . 3 amended .
Section 400 . 3 is amended to read as follows :
" 400 . 3 . Moving buildings .
" ( a ) No building or structure of wood
frame construction or unprotected noncombustible
construction shall be moved from without to
within the fire limits or from one lot to

another lot within the fire limits or from one loca -
tion on the same lot within the fire limits except :
( 1 ) That moveable metal buildings with metal
frames and coverings may be moved within the
fire limits when used for cafe purposes .
( 2 ) That metal house trailers may be moved
within the fire limits provided they are located
in an established trailer court or mobile home
park . 0

SECTION 2 . That Section 6 - 76 of the Fayetteville Code of
Ordinances be amended by deleting the present languageof said
Section and substituting the following :
Sec . 6 - 76 . Section 400 . 5 amended .
Paragraphs (m) and ( n) are hereby added to Section
400 . 5 , entitled " Exceptions to restrictions within
fire limits " , to read as follows :
" (m) Single family and duplex family dwellings
of wood frame or masonry veneered construction
not exceeding two stories in height may be
erected or additions made thereto when located
in the fire limits provided inside partitions ,
walls , and ceilings have a fire resistance
rating of not less than one ( 1 ) hour .
( n ) Noncombustible walls or panels may be
permitted in exterior non-bearing walls in the
fire limits under the following conditions :
LT ( 1 ) Provided such walls are of non-
combustible material .
( 2 ) Provided such walls face a street
or permanent open space of thirty ( 30 ) feet
or more in width .

( 3 ) Provided all other such walls that do
not face a permanent open space of thirty ( 30 )
feet or more in width meet the non- bearing wall
requirements of ordinary type construction as
set out in the City Building Code . "
SECTION 3 . That nothing contained in this ordinance
shall be construed as affecting , repealing or amending any pro-
vision of the ordinances of the City of Fayetteville , save for
the Sections of the Fayetteville Code of Ordinances specifically
amended herein .
SECTION 4 . That this ordinance shall be in full force and
effect from and after its passage , aoval and publication .
