AN ORDINANCE AMENDING ZONING ORDINANCE NO , 1239 , AND REVISED
ZONING DISTRICT MAP OF FAYETTEVILLE , ARKANSAS , APPROVED MAY 28 ,
1962 , AS AMENDED , TO REZONE CERTAIN REAL ESTATE FROM 0- 1 OPEN
LAND DISTRICT TO C- 2 THOROUGHFARE COMMERCIAL DISTRICT .
WHEREAS , a public hearing was held before the Planning Com-
mission of the City of Fayetteville , Arkansas , on February 28 ,
1967 , on the petition of Johnie Bassett , requesting the said
Planning Commission recommend to the Board of Directors of the
City of Fayetteville , Arkansas , that the Board of Directors en-
act an ordinance rezoning the following described property ,
presently zoned 0- 1 Open Land District , to C- 2 Thoroughfare Com-
mercial District , to-wit :
A part of the Southeast Quarter ( SE 1/4 ) of the South-
east Quarter ( SE 1/ 4 ) of Section Twenty-Three ( 23 ) and
part of the Northeast Quarter (NE 1/4 ) of the North-
east Quarter (NE 1/ 4 ) of Section Twenty-Six ( 26 ) in
Township Seventeen ( 17 ) North of Range Thirty ( 30 )
West , described as follows , to-wit : Beginning at the
Southwest Corner of the Southeast Quarter ( SE 1/4 ) of
the Southeast Quarter ( SE 1/ 4 ) of Section 26 , and run-
ning thence North 480 . 38 feet , thence East 741 . 6 feet ,
thence South 620 feet , thence West 741 . 6 feet , thence
North 139 . 62 feet to the point of beginning ; and
WHEREAS , notice of said public hearing , setting forth the
date , time , place and purpose of hearing , and location of the
property was published in the Northwest Arkansas Times , a news -
paper of general circulation in said City , more than 15 days
prior to said public hearing , and
WHEREAS , following said public hearing said Planning Com-
mission certified to the Board of Directors of the City of
Fayetteville , Arkansas , its recommendation that anAlrdinarlce be a6°r`e
adopted rezoning only the following portion of the g de -
scribed property , presently zoned 0- 1 Open Land District , to C- 2
Throughfare Commercial District , to-wit :
A part of the Southeast Quarter ( SE 1/ 4 ) , of the South-
east Quarter ( SE 1/ 4 ) , of Section 23 , Township 17 North ,
Range 30 West , of the 5th P . M . , County of Washington ,
State of Arkansas , and being more particularly described
as follows , to-wit : Beginning at a point on the Q ast
right of way of U . S . Highway No . 71 , said point of

37 . 5 feet , from a Stone marking the Southeast Corner
of said 40 , thence North 0024 ' West , along said right
of way 160 . 0 feet , thence East 167 . 0 feet , thence
South 0 ° 24 ' East 160 . 0 feet , thence West 167 . 0 feet ,
to the point of beginning .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1 . That the following described property , present-
ly zoned 0- 1 Open Land District , be and the same is hereby re-
zoned to C- 2 Thoroughfare Commercial District , to-wit :
A part of the Southeast Quarter ( SE 1/ 4 ) , of the South-
east Quarter ( SE 1/ 4 ) of Section 23 , Township 17 North ,
Range 30 West , of the 5th P . M . , County of Washington ,
State of Arkansas , and being more particularly described
as follows , to-wit : Beginning at a point on the last
right of way of U : S . Highway No . 71 , said point of
beginning being 1263 . 3 feet West and North 0024 ' West ,
37 . 5 feet , from a Stone marking the Southeast Corner
of said 40 , thence North 0024 ' West , along said right
of way 160 . 0 feet , thence East 167 . 0 feet , thence
South 0 ° 24 ' East 160 . 0 feet , thence West 167 . 0 feet ,

SECTION 2 . That all ordinances or parts of ordinances in
conflict herewith are hereby repealed , and this ordinance shall
be in full force and effect from and after its passage , approval
