AN ORDINANCE MAKING IT UNLAWFUL TO INJURE OR TO FAIL TO RETURN
ANY BOOK , PERIODICAL OR PROPERTY BELONGING TO THE PUBLIC LI -
BRARY OF THE CITY OF FAYETTEVILLE , ARKANSAS , AND PRESCRIBING
PENALTIES FOR VIOLATION THEREOF .
WHEREAS , the Public Library of the City of Fayetteville ,
Arkansas , has in recent months repeatedly encountered difficul-
ty in securing return of books and other publications loaned to
certain users of the Library , who thereafter refused or failed
to return said publications to the Library , despite repeated
requests and demands therefore , and
WHEREAS , it is the desire of the Board of Directors to see
that all persons borrowing books from said Library return them
as required by the Library , and to further prevent injury to
the publications of said Library .
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1 . It shall be unlawful for any person or persons
to injure , or to fail to return to the Public Library of the
City of Fayetteville , Arkansas , after written demand therefor
mailed to the last known address of such person or persons , any
book , periodical or property belonging to said Library . Said
written demand shall state that demand is being made pursuant
to the authority contained in this ordinance , and that failure
to return the book , periodical or property specified within 10
days from the date shown on said written demand shall be consid-
ered a violation of this ordinance resulting in prosecution
therefor .
SECTION 2 . Any persons violating the provisions of this
ordinance shall upon conviction of same be guilty of a misde-
meanor , and shall be fined in an amount not less that $ 25 . 00
nor more than $ 100 . 00 .
SECTION 3 . Nothing herein shall be construed as in any
way affecting or terminating the system of civil fines and ad-
ministrative sanctions now or hereafter employed by said Li -
brary in connection with its program of lending books , periodi-
cals and other property , but shall be supplementary thereto .
SECTION 4 . This ordinance shall be in full force and ef -
fect from and after its passage ,_approval and publication , and

the City Clerk is hereby authorized and directed to transmit a
certified copy of this ordinance to the publisher of the
Fayetteville Code of Ordinances for inclusion in the next quar-
terly supplement of same as Section 13- 11 of the Code of Ordi -
nances .
