WHEREAS , a public hearing was held before the Planning Commission of the Ct y of
Fayetteville , Arkansas , on February 15 , 1966 , on the petition of John D . Askew , request-
ing that said Planning Commission recommend to the Board of Directors of the City of
Fayetteville , Arkansas , that the Board of Directors enact an ordinance rezoning that
portion of the following described territory , presently zoned I- 2 Heavy Industrial District ,
to-wit:
A part of the NW 1 / 4 of the SE 1 / 4 of Section 21 , Township 16 North , Range 30
West , described as follows : Beginning at a point on the East line of the original
survey of State Highway ( now U . S . 71 ) which is 26 rods and 6 links West of the
NE corner of said 40 acre tract , and running thence East 26 rods and 6 links to
said 40 corner ; thence South 645 feet; thence South 810 West 523 . 9 feet to point
on the East line of said original State Highway ; thence North 8031 , East 730 feet;
more or less , to the place of beginning , containing 6 . 09 acres , more or less ,
except 25 feet of equal and uniform width off the North side deeded to the City of
Fayetteville for street purposes ,
from I- 2 Heavy Industrial District to C - 2 Thoroughfare Commercial District , and
WHEREAS , notice of said public hearing , setting forth and date , time , place and
purposes of said hearing and location of property was published in the Northwest Arkansas
Times , a newspaper of general circulation in said City , more than 15 days prior to said
public hearing , and
WHEREAS , following said public hearing , said Planning Commission certified to the
Board of Directors of the City of Fayetteville , Arkansas , its recommendation that an
ordinance be adopted rezoning that portion of the above - described territory , presently
zoned I- 2 Heavy Industrial District, to C - 2 Thoroughfare Commercial District ,
NOW , THEREFORE , BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE , ARKANSAS :
SECTION 1 . That the portion of the above - described property presently zoned I- 2
Heavy Industrial District be , and the same is hereby rezoned to C - 2 Thr.- ..ughfare Com-
mercial District .
SECTION 2 . That all ordinances or parts of ordinance in conflict herewith are here -
by repealed, and this Ordinance shall be in full force and effect from and after its passage ,
approval and publication .
