CIRCUIT CLERK
WHEREAS , at the request of the City Council , a public hearing was held before
the Planning Commission of the City of Fayetteviiie . Arkansas , on ' November 18 , 1964,
to discuss a proposed amendment to Zoning Ordinance No. 1239 concerning.-the zoning of
newly annexed territory , and
WHEREAS , notice of said public hearing , setting forth the date , time ; place and
purposes of hearing , and location of property was puLlished in the Northwest Arkansas
Times , a newspaper of general circulation in said City , more than 13 days prior to said
public hearing , and
WHEREAS , following said public hearing , and after the question had been referred
back to the Planning Commission for further study , by the City Council , said Planning
Commission certified to the City Council of the City of Fayetteville , Arkansas , its
recommendation that the newly annexed territory come into the City zoned O- 1 Open
Land District ,
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE , ARKANSAS :
SECTION 1 . That Ordinance No . 1239 , Article III , Section 1 , Classifications of
Districts , be amended by the addition of a new zoning district , to be known as A- 1
Annexed Territory District .
SECTION 2 . That Ordinance No . 1239 , Article IV , Section V , Zoning of Annexed
Territory , be amended to read as follows :
"SECTION 5 . Zoning of Annexed Territory .
All territory which may hereafter be annexed to the City shall be governed by and
subject to the requirements of A- 1 Annexed Territory District until such time as the
Zoning District Map shall have been amended to authorize other use or uses for the newly
annexed territory . This district is intended to designate land located on the fringe or
urban areas which is generally undeveloped or is used primarily for agricultural purposes
but where future urbanization is expected. The regulations which are authorized for the
district,,:.therefore , are designed to encourage and protect open land and agricultural uses
until , u�kYfih7Cley as urbanization is warranted and the appropriate change in district

Ordinance No . 1425 - 2 - November 23 , 1964
b . Public and semi -public uses such as schools , churches , public
services and utilities , airports and landing field , parks , play-
grounds , golf courses and driving ranges , including customary
accessory uses and buildings .
c . Agricultural uses , including horticulture , nurseries , orchards ,
forests and forestry , apiaries , field crops , the breeding and
raising of livestock , and riding stables , provided that all stables ,
barns , animal sheds or shelters shall be located not less than
one hundred ( 100) feet from any property line . Agricultural uses ,
further , are subject to the following exceptions and conditions :
1 ) Farms devoted to hatching , raising , breeding and marketing
of chickens , turkeys or other poultry , fowls , rabbits , fur -
bearing animals , fish or frogs shall have a tract , lot or
parcel of not less than one ( 1 ) acre .
2 ) Killing , butchering or dressing of livestock , fowl , fish or
other animals raised on the premises for personal home
consumption of the property owner is permitted provided that
killings , butchering or dressing is done in an accessory
building which is located not less than one hundred ( 100 )
feet from any property line .
3) Hog raising for other than resident family consumption is
permitted on tracts , lots or parcels of more than five ( 5 )
acres , provided that feeding pens or shelters are no closer
than one hundred ( 100 ) feet from the property line of the
tract on which they are located .
4) Veterinary offices and animal hospitals .
5) Roadside stands for agricultural produce .
d . Trailer courts and mobile trailer homes on individual lots pro-
vided they are in compliance with City ordinances regulating such
trailer homes or trailer parks .
e . Home occupations - - any home occupation such as those offering
professional services , barbers , beauticians , dressmaking and
launderers , provided that no persons other than members of
the household are employed in such occupations and that not more
than twenty - five ( 25 ) per cent of the total floor area in any dwelling
unit is devoted to such use .
f. Radio and TV transmitting towers .
g . Heavy equipment storage .

h . Signs , free standing and informational , pertaining to public
improvements , the sale or lease of premises , or relating
directly to the use of the property involved and not exceeding
12 feet by 24 feet in size ; signs pertaining to home occupations
which do not exceed 2 feet by 3 feet in size .

Minimum Lot Area 2 acres
Minimum Lot Width 100 feet
Minimum Front Yard 35 feet
Minimum Side Yard 20 feet
Minimum Rear Yard 20 feet
3 . General Provisions
Off- street parking and other general requirements shall be subject
to the General Provisions set forth in Article IV . "
SECTION 3 . That this Ordinance shall be in force and effect from and after
its passage , approval and publication .
