WHEREAS , a public hearing was - held before the Planning Commission of the City of
Fayetteville , Arkansas , on Tuesday , April 14 , 1964 , on the petition of J. A . Russell
and Frances D . Russell , requesting that said Planning Commission recommend to the
City Council of the City of Fayetteville , Arkansas , that the City Council enact an ordinance
rezoning that part of the following described property, not already zoned C- 2 Thoroughfare
Commercial District , to- wit :
A part of the Southwest Quarter of the Southwest Quarter of Section 3 , Township
16 North , Range 30 West, being more particularly described as beginning at a
point 303 . 5 feet south of the northeast corner of said 40 acre tract , and running
thence south 880 34' West 382 . 6 feet , more or less , to an iron pin near the
edge of West bank of the branch; thence South 29 feet; thence North 820 16 ' West
with the line of the South face of an existing concrete wall 228 . 2 feet to an iron
pin at the South edge of an existing concrete slab where slab intersects with the
East right of way line of U . S . Highway No . 71 ; thence South 100 30 , West with
said right of way line 207 . 6 feet; thence running North 880 101 East with an
existing fence 372 . 0 feet; and continuing with said fence North 880 20 , East
271 . 9 feet to the east line of the above mentioned 40 acre tract , and thence north
196 . 3 feet to the place of beginning .

WHEREAS , notice of said public hearing , setting forth the date , time , place and
purposes of hearing , and location of property was published in the Northwest Arkansas Times ,
a newspaper of general circulation in said City , more than 15 days prior to said public
hearing , and
WHEREAS , following said public hearing , said Planning Commission certified to
the City Council of the City of Fayetteville , Arkansas , its recommendation that an
ordinance be adopted rezoning the above - described property from R - IA Single Family
Residential District to C- 2 Thoroughfare Commercial District;
NOW , THEREFORE , BE IT ORDAINED BY THE CTTY COUNCIL OF THE CITY OF
FAYETTEVILLE , ARKANSAS:
SECTION 1 . That the above - described property not already zoned C- 2 Thoroughfare
Commercial District , be rezoned from R - lA Single Family Residential District to
C= 2 Thoroughfare Commercial District .

SECTION 2 . That all Ordinances or parts of Ordinances in conflict herewith are
