HomeMy WebLinkAboutOrdinance 1381 ORDINANCE NO., 2 AN ORDINANCE ESTABLISHING THE DEPARTHW OF FINANCE OF THE CITY OF FAYETTEVILLE; FIXING THE RESPONSIBILITIES OF THE CITY CONTROLLER; ESTABLISHING THE RELATIONSHIP BETWEEN THE MAYOR, THE COUNCIL, OTHER ELECTED MUNICIPAL OFFICIALS, AND THE DEPARTMENd OF FINANCE; DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES, WHEREAS, it is compatible with good accounting practice that the City Council establish one agency of municipal government to supervise the collection and disbursement of funds according to rules and regulations adopted by the City Council, and WHEREAS, the establishment of proper procedures dealing with such collection and dis= bursement requires adequate education and practice in the field of accounting, and WHEREAS, the tenure of elected officials is subject to the will of the people, but .the business of the City will continue from administration to administration and from City Council to City Council, and WHEREAS, all of the financial affairs of the City, both short range and long range ,, should be grounded in procedures fiscally sound, economically reasonable , and pledged to' the +eaxim m utilization for all of the governmental needs of the City of Fayetteville , NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE : SECTION I . There is hereby established the Department of Finance of the City of Fayetteville , SECTION II . The Department of Finance shall be headed by a person acceptable to the City Council and shall be known as the City Controller, SECTION III . The Department of Finance , upon the recommendation of the City Controller and the KWor, may be , at the discretion of the City Council, sub-divided into offices having specific areas of responsibility, such as but not restricted to collecting, disbursing, and internal auditing, SECTION IV. It shall be the duty of the Department of Finance to : (A) Collect, record, issue receipts for all fluids legally levied by the. municipal government of the City of Fayetteville and to perform this service in accord- ance with the rules and regulations governing collection, recording and re- ceiving as approved by the City Council, (B) To disburse money in accordance with the rules and regulations governing the ' disbursement of fluids as approved by the City Council , (C ) To advise the Council at stated intervals of the status of all funds , as well as the general fiscal status of the municipal .government , (D) To present to the City Council suggested rules and regulations or changes in current rules and regulations that would improve systems for collecting, disbursing, or budgeting fluids. (E) To recommend to the City Council the investment of surplus funds , . MICROFILM.D 1978 DATE9 REEL \�1 �._— -2- (F) To assist and advise with the Mayor, other elected officials , department heads and the City Council in the construction of the annual budget and in long range projects requiring either the acquisition of new funds or the build-up of retained funds to achieve a capital outlay not feasible in the annual budget . (G) To supervise the spending of the funds allocated by the. City Council in . the annual budget in order that each item of disbursement will be in compliance with the rules and regulations adopted by the City Council governir„g budgetary expenditures . SECTION V If any section, subsection, sentence , clause or phrase of this ordinance is for any reason declared unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this ordinance . SECTION VI . Whereas the passage of this ordinance is necessary for the preservation of the public health, peace and safety, an emergency is hereby declared to exist , and this ordinance shall be in full force and effect from and after its passage and approval.
