DISTRICT; AMENDING THE ZONING DISTRICT MAP SO AS TO DESIGN49$FuTf�R�UBOVNDARY
OF THE 0- 1 OPEN LAND DISTRICT ; AND FOR OTHER PURPOSES , CIPC�
WHEREAS , public hearings were held before the Planning Commission of the City of
Fayetteville , Arkansas , on Septernber 12 , 1961 , December 15 , 1961 , and December 28 , 1961 ,
for the purpose of discussing certain amendments and changes to the Zoning Ordinance No .
1239 , passed and approved June 13, 1960 , and
WHEREAS , notices of said public hearing , setting forth the dates , times , places and
purposes of said Bearings , and location of property were published in the Northwest Arkansas
TIMES , a newspaper of general circulation in said City, more than 15 days prior to said
public hearing , and
WHEREAS , following said public, hearings , said Planning Commission certified to the
City Council of the City of , Fayetteville , Arkansas , its recommendation that an ordinance
be adopted making the changes and amendments as hereinafter set out .
NOW, THEREFORE ; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEV ILLE , ARKANSAS :
SECTION 1 . That Article V . Provisions Governing Zoning District , of Ordinance No .
1239 , passed and approved June 13 , 1960 , be and the same is hereby amended by the
addition of Section 14 , which reads as follows :
Section 14. O- 1 Open Land District
This district is intended to designate land located on the fringe of urban areas
which is generally undeveloped or is used primarily for agricultural purposes but where
future urbanization is expected. The regulations which are authorized for the district ,
therefore , are designed to encourage and protect open land and agricultural uses until such
time as urbanization is warranted and the appropriate change in district classification
is made .
1 . Uses Permitted
a. Single- family dwellings , two- family dwellings , multi-family dwellings , and
rooming houses .
b . Public and semi- public uses such as schools , churches , public services and utilities ,
airports and landing fields , parks , playgrounds , golf courses and driving ranges ,
including customary accessory uses and buildings .
c . Agricultural uses , including horticulture , nurseries , orchards , forests andforestry,
apiaries , field crops , the breeding and raising of livestock, and riding stables ,
provided that all stables , barns , animal sheds or shelters shall be located not less
than one hundred ( 100 ) feet from any property line Agricultural uses , further , are

1 ) Farms devoted to hatching , raising , breeding and marketing of chickens ,
turkeys , or other poultry , fowls , rabbits , fur - bearing animals , fish or frogs
shall have a tract , lot or parcel of not less than one ( 1 ) acre ,
2) Killing , butchering or dressing of livestock, fowl , fish or other animals raised
on the premises for personal home consumption of the property owner is per -
mitted provided that killings , butchering or dressing is done in an accessory
building which is located not less than two hundred ( 200 ) feet from any property
line ,
3 ) Hog raising for other than resident family consumption is permitted on tracts ,
lots or parcels of more than twenty ( 20 ) acres , provided that feeding pens or
shelters are no closer than two hundred ( 200 ) feet from the property line of
the tract on which they are located.
d. Trailer courts and mobile trailer homes on individual lots provided they are in
compliance with City ordinances regulating such trailer homes or trailer parks .
e . Home occupations - any home occupation such as those offering professional services ,
barbers , beauticians , dressmaking and launderers , provided that no persons other
than members of the household are employed in such occupations and that not more
than twenty- five ( 25 ) per cent of the total floor area in any dwelling unit is devoted
to such use .
f. Residential subdivisions developed in accordance with the requirements and pro-
cedures set forth in the subdivision regulations in effect in the City,
g . Signs , free standing and informational , pertaining to public improvements , the sale
or lease of premises or relating directly to the use of the property involved and not
exceeding 12 feet by 24 feet in size ; signs pertaining to home occupations which do
not exceed 2 feet by 3 feet in size .
2 . Uses Prohibited
Any commercial use , commercial slaughtering or industrial use , except as permitted
above or as they may be accessory to permitted uses .
3 . Area and Bulk Regulations
a . Uses involving residences shall comply with R - 4 Multi - Family Residential District
regulations .
b . Uses involving Subdivision Regulations . Lot sizes and setback requirements for
residential developments requiring a subdivision plat are governed by the minimum
design standards of the Subdivision Regulations and the area and setback regulations
of R = 4 Multi- Family Residential District.
c . Uses involving public or semi-public buildings .
Churches , private schools and private clubs
Minimum lot areas 3 acres
Public Schools
Minimum lot area- - as determined by the
Board of Education

4 . General Provisions
Off- street parking and other general requirements shall be subject to the General
Provisions set forth in Article N .
SECTION 2 , That Article V , Provisions Governing Zoning Districts , of Ordinance
No . 1239 , dated June 13 , 1960 , be and the same is hereby amended by adding Section 15 ,
which reads , to -wit:
Section 15 , R - P Professional Office Residential District
A district , predominantly residential , intended to accommodate professional office
uses which conform to standards generally consistent with the residential character
of the area .
1 . Uses Permitted
a. All uses permitted in R - lA and R - IB Single -family Residential District and only
residential uses permitted in R - 2 Two - Family Residential District .
b . Offices of professional persons including only doctors , dentists , musicians ,
artists , architects , attorneys , real estate brokers and beauticians , provided
that :
1 ) No window display or sign is used which is illuminated or more than one ( 1 )
square foot in size .
2) No more than two ( 2 ) office establishments in addition to necessary assistants
and office help occupy any one structure .
2 . Uses Permitted on Review by Board of Adjustment
a. Any professional uses similar to those permitted above in paragraph "B " under
part 1 , " Uses Permitted" .
3 . Uses Prohibited
a. All uses prohibited in R - IA and R - IB , Single - Family Residential District , and
R - 2 Two- Family Residential District .
b . Barbers , vererinary surgeons , catering services , and teachers providing
instruction to classes or groups of more than two ( 2 ) persons at one time .
4 . Area and Bulk Regulations
a.. The area and bulk regulations of R - 2 Two - Family Residential District shall apply ,
except:
1 ) Minimum lot area shall be 8 , 000 square feet for any office structure .
2) Maximum floor space at street level of any office structure shall not exceed
2 , 000 square feet .
3 ) Height shall be limited to one- story structure .

5 . Design and Appearance
a. Any building erected or structurally altered to accommodate a professional office
shall conform in general design and appearance to the residential character of
the district .
b . Plans for structural alterations of existing buildings for new structures for pro -
fessional offices shall be subject to review and approval by the Building Inspector
who may , however , refer questionable problems to the Planning Commission .
6 . Off- Street Parking
a . Any structure constructed or remodeled for professional office use shall provide
off- street parking on the side yards . Parking may be permitted in the front yard
with a minimum building setback of twenty- five (25 ) feet . All off- street parking
shall be in accordance with the requirements of Article IV , Section 7 " e " . However ,
if the structure accommodates two ( 2 ) professional occupants , a minimum of ten
( 10 ) off- street parking spaces shall be provided .
SECTION 3 . The boundary of the O- 1 Open Land District is hereby established as
shown on the amended Zoning District Map of Fayetteville , Arkansas , dated January 22 ,
1962 , which is a part of this Ordinance and which is on file in the office of the City Clerk .
SECTION 4 . All ordinances or parts of ordinances in conflict herewith shall be and
the same are hereby repealed , and this Ordinance being necessary for the preservation of the
public peace , health , comfort , convenience , morals , safety and welfare of the City of
Fayetteville , Arkansas , an emergency is hereby declared to exist and this ordinance
shall be in full force and effect from and after its passage , approval and publication .
