OF ZONING ORDINANCE NO, 12399 AS AMENDED BY SECTION 14 OF ORDINANCE NO.
1276 , TO PERMIT RESIDENTIAL USE IN THE C - 1 NEIGHBORHOOD AND C - 3 CENTRAL
COMMERCIAL DISTRICTS AND APARTMENTS AND ROOMING HOUSES IN THE C - 2
THOROUGHFARE COMMERCIAL DISTRICT: AND FOR OTf-LER, PURPOSES, AS AMENDED .
WHEREAS , a public hearing was held before the Planning Commission of the City of
Fayetteville , Arkansas , on November 28 , 1961 , for the purpose of discussing certain
amendments and changes to the Zoning Ordinance No . 1239 , passed and approved June 13 ,
1960 , as amended by Ordinance No . 1276 , passed and approved September 25 , 1961 , and
WHEREAS , notice of said public hearing , setting forth the date , time , place , and
purpose of said hearing and location of property was published in the Northwest Arkansas
TIMES , a newspaper of general circulation in said City , more than 15 days prior to said
public hearing , and
WHEREAS, following said public hearing , said Planning Commission certified to the
City Council of the City of Fayetteville , Arkansas , its recommendation that an ordinance
be adopted making the changes and amendments as hereinafter set out .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
SECTION 1 . That paragraph 1 , Uses Permitted , of Section 5 , R - 4 Multi - Family
Residential and Dormitory District , of Article 5 of Ordinance No . 1239 , dated June 13 ,
1960s be and the same is hereby amended to read as follows :
1 . Uses Permitted
a . Residential uses - - all uses permitted in Section 1 , R - IA, and Section
2 , R - IB , Single - Family Residential District , Section 3 , R - 2 Two-
Family Residential District , and Section 4 , R - 3 Multi- Family
Residential District .
b . Dormitory uses - - fraternity or sorority houses , rooming houses
and lodging houses .
C , Commercial parking lots - - such commercial parking lots may include a
small shelter for parking lot attendant. -
SECTION 2 . That Article 6 , Exceptions and Modifications , of Zoning Ordinance
No . 1239 , passed and approved June 13 , 1960 , as amended by Section 14 of Zoning
Ordinance No . 1276 , dated September 25 , 1961 , be and the same is hereby amended to
read as follows :

Ordinance No . 1282 - 2 - January 8 , 1962
Section 7 . Residential Uses in Industrial and Commercial Districts
a . In I- lA and I- 1B Light Industrial Districts , I- 2 Heavy Industrial Districts
and in C- 2 Thoroughfare Commercial Districts , single -family and duplex
family dwellings may be constructed on lots that front on open and improved
dedicated streets provided such construction conforms to the area and
set- back requirements of the R - 3 Multi- Family Residential District .
b .. To permit upon review and approval by the Board of Adjustment any type
of residential use in C - 1 Neighborhood Commercial District and in C- 3
Central Commercial District and also , any multi -family or rooming house
use in C- 2 Thoroughfare Commercial District , provided that such uses
conform to the area and setback requirements of the R - 4 Multi - Family
Residential and Dormitory District ,
SECTION 3 . All Ordinances or parts of ordinances in conflict herewith shall be and
the same are hereby repealed , and this Ordinance being necessary for the preservation
of the public peace , health , comfort , convenience , morals , safety and welfare of the
City of Fayetteville , Arkansas , an emergency is hereby declared to exist and this
Ordinance shall be in full force and effect from and after its passage , approval , and
publication.
PASSED AND APPROVED THIS 8th day of January, 1962 .
