WHEREAS , a public hearing was held before the P1an�trtkLf7?M �&xiLon of the City
of Fayetteville , Arkansas , on August 16 , 1961 , for the purposecotdis ng proposed
amendments to Ordinance No . 1245 , Sub - Division Regulations , Article IV , Minimum
Designs Standards , Paragraph F , Building Setback Lines , Subparagraph 2 and 3 , and
Article V , Improvements , Paragraphs D and E , and
WHEREAS , notice of said public hearing , setting forth the date , time , place and
purposes of hearing , and location of property was published in the Northwest Arkansas
TIMES , a newspaper of general circulation in said City , more than 15 days prior to said
,
public hearing , and
WHEREAS , following said public hearing , said Planning Commission certified to
the City Council of the City of Fayetteville , Arkansas , the following amendments to
Ordinance No . 1245 , which are herein adopted .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE , ARKANSAS:
SECTION I . That Article 1V , "Minimum Design Standards " , Paragraph F ,
"Building Setback Lines " , subparagraphs 2 and 3 , be and the same are hereby amended
to read as follows , to - wit :
2 . Side building setback lines on corner lots shall not be less than twenty-
five (25 ) feet from the property line on the intersecting street side . However ,
in case the subdivision is located in a zoning district in which the minimum
side building setback lines are more or less than those required by these
regulations , the zoning ordinance minimum requirement shall apply .
3 . Side building setback linesQn inside lots shall not be less than ten
( 10 ) feet from the property line . However , in case the subdivision is
located in a zoning district in which the minimum side building setback
lines are less than required by these regulations , the zoning ordinance
minimum requirement shall apply .
SECTION 2 . That Article V , Improvements , paragraphs D and E , be and the
same is hereby amended to read as follows , to -wit :
D . Street Grading , Surfacing , and Curb and Gutter .
All streets shall be constructed at the developer ' s expense in accordance with
the policies , standards and specifications established by the City Council .
E . Sidewalks . MICROFILMED

If property proposed for development within a subdivision fronts on a Collector
Street or a Thoroughfare , sidewalks four (4) feet in width may be installed in
accordance with policies established by the City Council .

Ordinance No . 1273 - 2 - September 11 , 1961
SECTION 3 . That all ordinances or parts of ordinances in conflict herewith are
hereby repealed, and this action being necessary for the public health , peace , safety ,
order , comfort and convenience within the City of Fayetteville , Arkansas , an emergency
is hereby declared to exist and this ordinance shall be in full force and effect from and
after its passage , approval , and publication .
