AN ORDINANCE TO VACATE AND ABANDON AN UNNAMED AND UNOPENREET
IN BROAD ACRES SUBDIVISION TO THE CITY OF FAYETTEVILLFy,� ARKANSAS . 0�
WHEREAS , Cecil T . Harris and Eva Mae Harris , husband an ife ,7re�eWents of
the City of Fayetteville , Arkansas , did on the 23rd day of June , 19 1 , ehet �' �/ion ,
duly verified, with the Council of the City of Fayetteville , Arkansa Opal i &bb iCotu�cil
for an ordinance to vacate and abandon an unnamed street situated ink crers "
a Subdivision at the North Half of the Northeast Quarter of Section Twenty} ((29 ) in
Township Sixteen ( 16 ) North, Range Thirty ( 30 ) West of the Fifth Principal Meridian,
Washington County, Arkansas , as shown by the Plat of said subdivision filed in the Office
of .the Circuit Clerk and Ex- Officio Recorder of Washington County, Arkansas , on August 7 ,
1926 , the said street being more particularly described as follows , to- wit :
Beginning at the Northwest corner of Lot One ( 1 ) of said Subdivision , a photostatic
copy of which has heretofore been filed herein and made a part of said petition, the
beginning point being two hundred thirty ( 230 ) feet West and thirty ( 30 ) feet South of the
Northeast corner of said Eighty (80 ) acre tract; thence South along the West line of Lots
One ( 1 ) , Eight (8 ) , Nine ( 9 ) , and to the intersection of the West line of Lot Eighteen ( 18)
with branch; thence in a Southwesterly direction with said branch to the intersection with
the East line of Lots Seventeen ( 17 ) , Ten ( 10 ) , Seven ( 7) , and Two ( 2) , to the North line
of siidlL t Two .( 2) and thence East thirty (30 ) feet to the point of beginning .
and;
WHEREAS , after due notice as required by law , the Council has , at the time and
place inentiotned in the notice , heard all persons desiring to be heard on the question and
has ascertained that said street has never been dedicated to the public as a street for
public use and in fact has never been used by the public as a street for a period of at
least five years subsequent to the filing of said plat nor for any other period of time ; that
the petitioners are the sole owners of the property abutting the street on each side thereof,
and that the public interest and welfare will not be adversely affected by the abandonment
of said street .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS :
SECTION 1 . The City of Fayetteville , Arkansas , hereby releases , vacates and
abandons all its rights , together with the rights of the public generally, in and to the street
as designated on said plat andas more particularly set out and described he'r'ein:
SECTION 2 . A copy of this Ordinance duly certified by the City Clerk of the City of
Fayetteville , Arkansas ; . shall be filed in the Office of the Circuit Clerk and Ex- Officio
