AN ORDINANCE TO CLOSE ALL PLATTED ALLEYS IN BLOCK "A" , #VERET��
SECOND ADDITION TO THE CITY OF FAYETTEVILLE , ARKANSAS ,/Y H HAVE OT
HERETOFORE BEEN VACATED AND ABANDONED PURSUANT TO > VISIONS OP
OF ORDINANCE NO, 919 , CITY OF FAYETTEVILLE , ARKANSAS

WHEREAS , a petition was duly filed with the4Council of the City 6ffj� vi1�,
Arkansas , on the 26th day of June , 1961 , asking the City Council to vacad bdandon
all platted alleys in Block "A" , Leverett ' s Second Addition to the City of Fa tteville ,
Arkansas , as shown and designated on the plat of said addition now appearing of record
in Plat Book A , Page 55 , in the . Office of the Recorder of Washington County , Arkansas , to
the extent said alleys have not heretofore been vacated and abandoned by action of said
City Council pursuant to the provisions of Ordinance No . 919 , City of Fayetteville , Arkansas ;
and
WHEREAS , the alleys and/ or portions thereof to be vacated and abandoned are
described as follows :
All alleys in Block "A" , Leverett' a Second Addition, to the extent not previously
vacated and abandoned by Ordinance No . 919 ;
More particularly described as : Beginning at a point which is the Northeast
corner of Lot One in Block "A" , Leverett' s Second Addition to the City of
Fayetteville , Arkansas , as shown in Plat Book A , at Page 55 , in the Office
of the Recorder of Washington County, Arkansas , and running thence North
fifteen ( 15) feet to the Southwest corner of Lot Three , thence East One
Hundred Forty ( 140 ) feet to the intersection with Lindell Avenue , thence
South fifteen ( 15) feet , thence West One Hundred Forty ( 140 ) feet to the
place of beginning , being the alley located between Lot Two and Lot Three
in said Block A.
Also , beginning at a point fifteen ( 15 ) feet North of the Southwest corner
of Lot Five in said Block A, said point being located on the West boundary
line of said Lot Five , and running thence North One Hundred Twenty- Seven
( 127) feet to the intersection with Douglas Street , thence West fifteen ( 15 )
feet, thence South One Hundred Twenty- Seven ( 127) feet, thence East
fifteen ( 15) feet to the point of beginning , being the portion of the alley lying
between Lots Four , Six and Eight on the West and Lots Three , Five , and
Seven, on the East , which has not been previously vacated and abandoned
by action of the City Council , City of Fayetteville , Arkansas .

WHEREAS , by Resolution duly adopted the said City Council has set July 24, 1961 ,
as the date for a public hearing on said petition ; secured the recommendation of the City
Planning Commission ( said recommendation being favorable ) ; caused to be published the
due notices as required by law giving the time and place of said public hearing at which all
persons desiring to be heard nn the question might appear , determined that the alleys
, and/ or portions here in issue have heretofore been dedicated to the public use as alleys ;
determined that all public utilities have consented to the abandonment ; that the petitioner ,
and of Trustees of the University of Arkansas , is an educational institution described
Arkansas Statutes , section 19 - 3825 and is the owner of all property abutting on said

alleys except for one lot which is being condemned by the said Board of Trustees and for
which a court order of taking has previously been issued in favor of said Board of
Trustees ; and
WHEREAS , after publication of legal notices referred to above , the Council has , at
the time and place mentioned in the notice , heard all persons desiring to be heard on the
question and has ascertained that the alleys and/or portions thereof described shall be
vacated and abandoned and that the public interest and welfare will not be adversely
affected by the abandonment of such alleys ;
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
SECTION 1 . The City of Fayetteville , Arkansas , hereby releases , vacates and
abandons all its rights , together with the rights of the public generally , in and to the
alleys and/ or portions thereof described as follows :
All alleys in Block "A" , Leverett' s Second Addition to the City of Fayetteville ,
Arkansas , to the extent not previously vacated and abandoned by Ordinance
No . 919 , City of Fayetteville , Arkansas .
More particularly described as : Beginning at a point which is the Northeast
corner of Lot One in Block "A" , Leverett ' s Second Addition , to the City of
Fayetteville , Arkansas , as shown in Plat Book A, at Page 55 , in the Office
of the Recorder of Washington County , Arkansas , and running thence North

boundary line f said Lot Five , and running thence North One Hundred
Twenty- Seven ( 127 ) feet to the intersection with Douglas Street, thence
West fifteen ( 15) feet, thence South One Hundred Twenty- Seven ( 127 ) feet ,
thence East Fifteen ( 15 ) feet to the point of beginning , being the portion
of the alley lying between Lots Four , Six , and Eight , on the West , and
Lots Three , Five , and Seven, on the East , which has not been previously
vacated and abandoned by action of the City Council , City of Fayetteville ,
Arkansas .
SECTION 2 .'. A copy of this Ordinance duly certified by the City Clerk shall be filed
in the Office of the Recorder of the County and recorded in the deed records of the County .
