THE CITY OF . FAYETTE'VILLE, ARKANSAS, AND PRESCRIBING FOR THE VIOLATIONS OF SUCH
RULES AND REGULATIONS , AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT THEREWITH, AND FOR OTHER PURPOSES ,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS
SECTION 11
TheCity Engineer of the City of Fayetteville, Arkansas, is hereby
authorized to prepare such Rules and Regulations in connection with the
standardization of the design, construction, and maintenance of street and alley
paving , including driveways , sidewalks , storm sewers, culverts and bridges,
materials, and construction methods, and including approvals of all such work,
and for other matters and things in connection with the construction and
maintenance of such work, which lies within the jurisdiction of the City of
Fayetteville, Arkansas, as to him shall seem proper, necessary or expedient.
Upon the preparation of such Rules and Regulations as herein provided, they shall
be submitted to the City Council of the City of Fayetteville, Arkansas, and upon
approval by the City Council of the City of Fayetteville, Arkansas, either by
motion or resolution, such Rules and Regulations shall govern the design,
construction, and maintenance of street improvements as stated in this section as
herein provided and shall repeal all rules , regulations , or ordinances in conflict
therewith .
SECTION 2 .
The prepared Rules and Regulations of the City Engineer of the City of
Fayetteville, Arkansas , when approved by the City Council of the City of
Fayetteville, Arkansas , shall have the same force and effect as law and violations
of such Rules and Regulations shall be punishable as hereinafter provided .
SECTION 3 .
Any person, firm or corporation violating any of these Rules and Regulations
of the City of Fayetteville, Arkansas , prepared and adopted herein provided shall

be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in
any sum not exceeding one hundred dollars ($100 . 00 ) and each day of such
violation shall be considered a separate offen4b .
SECTION 4 .
All ordinances or parts of ordinances in conflict with any of the Rules
and Regulations prepared and approved as provided herein are hereby repealed, or
in case such Rule or Regulation i s hereafter prepared and approved as provided
in this ordinance and there is then a conflict between present ordinances
applicable , the present ordinance or ordinances shall be repealed upon the
approval by the City Council of the City of Fayetteville, Arkansas , of such Rule
or Regulation .
SECTION 5 .
It appearing that many of the practices of the City of Fayetteville,
Arkansas, are uneconomical and are not presently serving equitably and have not
taken into consideration the materials and scientific progress on new material ,
an emergency is hereby declared to exist and this ordinance, being necessary for
the preservation &-the public peace and safety, shall be in full force and
effect from and after its passage and approval .
