AN ORDINANCE RELATING TO THE ZONING LAWS OF THE CiTY OF '
FAYETTEVILLE , ARKANSAS : REPEALING ZONING ORDINANCE 1002 ,
ADOPTED SEPTEMBER 10 , 19519 AND ALL OTHER ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF-
SUCH CCNFLICT : PROVIDING FOR THE SEVERABILITY OF THE PRO -
V IS IONS HEREOF
ARTICLE I PURPOSE
The zoning regulations and districts as herein set forth are
enacted to implement in part the land use plan - of the City of
Fayetteville ' and to promote the health , safety , morals , conven -
ience , order , prosperity , and general welfare of the communit-y ;
to provide for the establishment of districts within the cor - '
porate - limits ; to regulate within such districts the Location , -
height , bulk , number of stories , and size of ' buildings and struc -
tures , the percentage of lot occupancy , the required open spaces ,
the density of population and the uses of land and buildings . ThZse
regulations have been made with reasonable consideration , among
other things , as to the character of each district and its
peculiar suitability for particular uses , and with a view of con —
serving the value of buildings and encouraging the most appropriate
use of land throughout the City ,

ARTICLE I I DEFINITIONS
Unless otherwise stated , the following words shall ; for the
purpose of this ordinance , have the meaning herein indicated ,
Words used in the present tense include the future . The singular
number includes the plural and the plural the singular . The
word " shall " is mandatory , not directive . The word "may " is per —
missive . The word " person " includes a firm , association , organi —
zation , partnership , trust , company or corporation , as well as an
individual .
I . Accessory use or building - - A use or building customarily
incident and subordinate - to the actual principal use or building
and located on the same lot with such actual principal use or
building ,
2 . Alley - - A minor public way used for utility easements
and vehicular service access to back or side of property facing
a street .
3 . Buildinq or structure - - Any structure constructed or used
for residence , business , or industry , or other public or private
purposes , or - accessory thereto , and including tents , lunch wagons ,
dining cars , mobile or trailer homes , billboards , signs , swimming
pools , telephone booths , ice makers , vending machines , incinerators ,
and similar structures whether stationary or movable .
a . Principal building - - a building in which is conducted
the principal use of the lot on which - it is located ,
In any residence district any dwelling shall be deemed
to be the principal building on the lot on which same
is located .
b . Accessory build. ing - - a subordinate building , the use of
which is incidental to that of a principal building on
the same lot .
c . Building line , front - - a line established in general ,
parallel to the front street line , between which and
the street no building shall project . This includes
covered porches whether enclosed or unenclosed , eaves
and overhangs , attached car ports and garages , and
steps where the steps project more . than five ( 5 ) feet
from the front building I .ine ,
d . Building height - - the vertical distance from the
established average sidewalk grade or street grade ,
or . finished grade at the building line , whichever is
highest to the highest point of the building , ex —
cluding spires , towers and domes not for human occupancy ,
flag poles , masts , or aerials .

40 Club or Lodge - - A building or portion of a building used
by an association for the promotion of some common objective ,
excepting clubs : the . chief activity of, which is a service customarily
carried on as a business .
5 . Court - - An unoccupied space , open at the top , wholly or
partially enclosed by the walls of a building or group of buildings .
it may serve at the grade level or at the level of any floor of an
adjacent building which it serves .
6 . District - - A section or sections of the City of Fayetteville
for which regulations governing the use of buildings and premises ,
and building height and area , are prescribed .
7 . Dormitory - - A building or group of buildings designed or alter ¢ (
for the purpose of accommodating students or members of religious
orders with sleeping quarters , with or without communal kitchen
facilities , and administered by bona fide education or religious
institutions .
8 . Dwellinq - - A house , apartment building , or other building
designed or used primarily for human habitation . The word " dwelling "
shall not include hotels , motels , motorists hotels or other structures
designed for transient residence .
a . Single - family dwelling - - a detached residence designed
for or occupied by one family only .
b . Two - family dwelling - - a residence designed for or
occupied by two families only , with separate housekeeping
and cooking facilities .for each .
C . Multi -family dwelling - = a residence designed for or
occup. ied by three or more families with separate
housekeeping and cooking facilities for each .
9 . Family - - One or more persons related by blood or marriage , or
a group of not more than four persons who need not be related by
blood or marriage , living together and subsisting in common in a
dwelling unit as a separate non -profit housekeeping unit which pro
vides only one kitchen as distinguished from a group occupying a
boarding house , lodging house , dormitory , sorority or fraternity housE
10 . Fraternity or sorority house - - A building owned or leased by
a general or local c apter of some regularly organized college fra -
ternity or sorority , or . by _ or on - Its behalf by a building corporation
or assoclation composed of members or alumni thereof , and occupied
by the local chapter of such fraternity or sorority as a place of
residence .

II , Garage apartment-- A family unit located over , or attached
to a private garage and located on the same lot with the 'principal
building .
12 . Gasoline service station - - An establishment the business of
which is the opera ion of a mo or fuel filling station , where repair
work is limited to lubricating and washing of motor vehicles , changing
and minor repair of tires , and where no body work or major chassis
or motor repairs are made ,
13 . Home occupation - - Any occupation of a service character which
is clearly secondary to the main use of the premises as a dwelling
place and does not change the character thereof or have any exterior
evidence of such secondary use . This occupation shall be carried on
or conducted only by members of the family res .idIng in the dwelling
and in connection with which there shall be no stock in trade or
commodity for sale upon the premises . The giving of voice or musical
Instrument lessons shall be limited to a single pupil at a time . Power
shall be limited to one -quarter ( ;) H . P . per machine , or a total of
one ( 1 ) H . P . for machines other than those used for domestic purposes ,
14 . House , boarding - - A dwelling where meals , or lodging and
meals , are provided for compensation , or . where. meals may be available
on a commercial basis , for two ( 2 ) or more persons pursuant to
previous arrangements , but where meals and lodging are not available
to the transient public ,
15 , Hous ¢ lodginq or rooming - - A dwelling or building where
lodging is provide or two ( or more persons for compensation ,
pursuant to previous arrangements , but which is not available to
transients and with which no table board is furnished .
16 . Lot - - 'A piece , parcel or plot of land in . one ownership which
may include one or more ' lots of record , occupied or to be occupied
by one principal building and its accessory buildings and including
the open spaces required under this ordinance . All lots shall front
on and have access to a public street .
a . Lot line - - the boundary dividing a given lot from a
. street , an alley , or adjacent lots ,
b . Lot of record - = a lot the boundaries of which are filed
as legal record .
c . Double frontage lot - - an interior lot having frontages
on two streets , as distinguished { roma corner lot ,

17 . Motel - - A building or overnight cabins for motorists which .
are not over two stories in height and where at least fifty percent
of the guest rooms are on the ground floor level and open directly
on a private roadway or court , and where at least one parking space
is provided for each guest - room ,
a . Motorist hotel - - a hotel for motorists which is more
than two stories in height .
18 . Nonconforming use - - A use of a building or of land which does
not conform with the provisions of this ordinance for the district in
which it is located .
19 . Parking space - - The area required for one automobile , which
In this ordinance is held to be an area ten . feet wide and twenty feet .
long , not including passage ways .
20 . Place of public assembly - - A meeting pla.ce for more than
fifty ( 50 ) persons to which the public or membership groups are
assembled regularly or occasionally , including but not limited to
schools , churches , theatres , auditoriums , funeral homes , stadiums ,
and similar places of assembly . Classrooms within a school , or - school 's
without auditoriums or gymnasiums , nurseries , and a public or private
building or institution without auditorium space are not , according
to this definition , places of public assembly .
21 . Professional office - - An . office of persons of recognized
professions , such as octors , lawyers , architects , engineers , realtors ,
artists , brokers , teachers , and others who through training are
qualified to perform services of a professional nature .
22 , Story - - " That portion of a building , other than a basement ,
included between the surface of any floor and the surface of the
next floor above ; or any portion of a building used for human occupant )
between the topmost floor and the roof . A half story refers to the
space between ' the top floor and a sloping roof ,
23 . Street - - A dedicated public right —of —way which affords
principal means of access to abutting .property . The word " street " shat
include the words " road " , " highway " , and " thoroughfare " ,
24 , Total floor area - - The area of all floors of a building , in —
cluding finished attic ; finished basements , attached car ports ,
attached garages , and covered porches .
25 . Mobile or Trailer court - - Any plot of ground on which there
are Iocdted or intended to be located two or more mobile or trailer
homes to be occupied for dwelling or sleeping purposes .

26 . Mobile or Trailer home - - Any vehicle used or so constructed '
as to permit its being used as a conveyance upon the public
streets or highways and duly licensable as such , and constructed
in such a manner as will permit occupancy thereof as a dwelling or
sleeping place for one or more persons .
27 . Variance - - A modification or variation of the provisions of
this ordinance as applied to a specific piece of property .
28 . Yard - - An open space on the same lot with a principal build -
ing , open and unoccupied and unobstructed by buildings from the
ground to the sky except for the ordinary projection of window sills ,
cornices , chimneys or chimney foundation buttresses , and other •
ornamental features , and as further defined below .
a . Front yard - - the yard extending across the entire
width of the lot between the street right - of -way
line and the nearest part of the principal building ,
including covered porches , attached garages , car ports ,
eaves and roof overhangs . If the principal building is
Iocafed . on a lot at the corner of intersecting streets ,
the front yard extends from the side of the structure
with the main entrance to the street line .
b . Rear yard - - the yard extending across the entire width
of the lot between the rear lot line and the nearest
part of the principal building , including covered
porches , attached garages , attached car ports , eaves
and overhangs . The rear of the principal building
shall be interpreted to be that part of the building
which is opposite to the side on which the front entrance
is located .
c . Side yard - - a yard extending along the side lot line
from the front yard to the rear yard and lying between
the side lot line and the nearest part of the principal
building , including porches , attached garages , attached
car ports , eaves and overhangs .
d . Official set -back line - - where an official set -back line
has been established for future widening or opening
of ' a street upon which a lot abuts , then the width or
depth of a yard shall be measured from such official
set -back line to the nearest line of the principal
building , including porches , attached garages , attached
car ports , eaves and overhangs .

ARTICLE I ' I I ESTABLISHMENT OF DISTRICTS "
Section I . Classification of Districts
For the purpose of this ordinance , Fayetteville , Arkansas has thir -
teen zoning districts designated as follows :
R - IA Single Family Residential District
R - IB Single Family Residential District
R -2 Two - Family Residential District
R -3 Multi -Family Residential District
R -4 Multi - Family Residential and Dormitory District
C - 1 Neighborhood Commercial District
C -2 Thoroughfare Commercial District
C -3 Central Commercial District
I - IA Light Industrial District
1 - I8 Light Industrial District
I -2 Heavy Industrial District
P - 1 Institutional District
P - IA Special Church District
Section 2 . Boundaries of Districts
I . The boundaries of the zoning districts are hereby established
as shown on the map entitled " Zoning District Map of Fayetteville ,
Arkansas " daied June 13 , 1960 , which is a part of this ordinance
and which is on file in thi office of the City Clerk .
2 . Unless otherwise indicated on the zoning map , the. district
boundaries are lot lines , the center lines of streets or alleys or a
specified - distance therefrom , railroad rights - of -way , or the city
limit lines as they existed at the time of the enactment of this ord -
Inance . Questions concerning the exact locations of district
boundaries shall be determined by the Board of Adjustment .
3 . When the street or property layout existing on the ground is
at variance with that shown on the Zoning District Map or with other
requirements of this article , the Board of Adjustment shall interpret
the boundaries .
4 . Where a district boundary line divides a lot in single owner -
ship at the time of passage of this ordinance , the use , height , and
area authorized in the least restricted district shal . l apply to the
entire lot , but shall not extend beyond a platted lot line ; provided
that . this line does not extend more than twenty -five ( 25 ) feet beyond
the more restricted district boundary line , The use so extended shall
be deemed to be conforming . Where the district boundary is on a
platted lot line , this extension is not permitted .

5 . Where a lot under single ownership at the time of passage
of this ordinance is a double frontage lot and where the frontage .
on one street is in a commercial or industrial zoned dlstrict . lexcept
corner lots ) and the frontage on the other . streei 1s in a residential
district or faces a residential district , any commercial or industrial
uses placed upon this lot shall be fronted onto the streetjn the
commercial or industrial district . In all cases of ambiguity or
uncertainty , the Board of Adjustment shall have the authority to
determine on which street the commercial or industrial use shall face
or front so that the spirit of these regulations shall be observed .
6 . Where a corner lot with commercial zoning is located on a
predominantly commercial street , 1 , e ., located In a block in which
the frontage is 51 % or more commercial , and the intersecting street
is predominantly residential , i . e . , 51 % or more residential frontage ,
any commercial use placed on the corner lot must have its principal
frontage on the predominantly ( 51 % or morel commercial street .

ARTICLE IV GENERAL PROVISIONS
For the purpose of this ordinance there shall be certain general
provisions which shall apply to the city . as - ' a whole as follows : .
Sect ( on Is . Use of Building and Land
No building or land shall hereafter be used and no building or part
thereof shall be erected , moved , or altered unless for a use expressly
permitted by and . in conformity with the regulations herein specified
for the district in which it is located .
Section 2 . Nonconforminq Uses
1 , Any lawful u'se of buildings or land existing at the time of
the enactment of this ordinance but not in conformity with its pro —
visions may be confined with the following limitations :
a . A--lawful nonconforming use of a building may not be change (
unless changed to an equal or a higher ( more restricted )
use .
b . Any building that constitutes a nonconforming use which
has been damaged by fire , explosion , act of God , or by
the public enemy to the extent of more than 75 percent of
its value shall not be restored except in conformance
with, the district in- which if , is located . The determina —
tion of whether a building is 75 percent destroyed shall
rest with the city building inspector .
c . A lawful nonconforming use that has been voluntarily
d.iscontinued . for a period - of six calendar months shall
not be continued at a later date .
d . A. lawful nonconforming use , if changed to a conforming
use , may not thereafter be changed to a nonconforming
use .
e . No building whose use does not conform with the provisions
of fhe district within which it is located shall be
enlarged , extended , � ec.onstrucfed , or structurally altered
( except f.or normal maintenance or when so required by
law or ordinance ) unless such u;se . is changed to - a use
that is in conformance with the provisions of the district
within which it is located .

f, If ownership of a nonconforming building or place of
business changes b,r if a. nonconforming building or place
• of business `is leased after the passage of this Ordinance,
only an'equal use -or a use conforming to the requirements
of the zoning- district ihVolved sill be permitted.
2: All signs arid .bit lboar.d not conforming with the provisions of
this Ordinance shall be removed within a.per,iod of one (1) year from
the effective date of this Ordinance; exceptthat:
a. All nonconforming signs end biUboards'relating to a
building or place of business arid located on the same
premises as such building or place of business,, may be
continued during the lawful lifetime of Such building or
place of business.
b. If a nonconforming sign or billboard is located off the
premises of the building or place of business to which
the sign or billboard perta ins, the •owner of the sign
or billboard sha II place on record in the office of the
Building Inspector, within one Cl) year following the
adoption of this Ordinance, information regarding any
lease agreement. that is in effect and other information
describing the existing sign or billboard. If a lease
is in effect,. the owner of the sign or billboard shall
remove it at the end of the lease period. However, if a
lease is not in effect the owner shall remove the non—
conforming sign or billboard within one (I) year from the
effective date of this Ordinance.
No owner of a lawful nonconforming building or place of business may
erect or locate any sign or billboard on the premises without first
obtaining the consent in writing of the owners or the duly authorized
agents of said owners, owning at least seventy five (75) percent of
the frontage of all property within three hundred (300) feet of the
premises on which said sign or billboard is proposed to be erected
or located. Said consents shall be filed with the Building Inspector
before a permit shall be issued for the erection or location of such
sign or billboard,
3. After the effective date of this ordinance, any nonconforming
use existing or under construction in an area annexed by the City
shall be regarded as a lawful nonconforming use as provided in this
ordinance, provided that construction is completed within one year
after date of annexation,
Section.3, Principal Building on Lot
I. In residential districts only one principal building and its
customary accessory buildings may hereafter be erected on any lot
unless otherwise provided in this ordinance,

2. The equipment of an accessory bu'i1.d.ing..w.ith sink, cook stove,
or other kitchen facilities for the independent occupancy thereof
other than by servants or guests shall be considered evidence that
such bui:l.ding.i.s not an accessory building but a separate dwelling
and must meet all minimum lot area and yard requirements, of the
district in which it is located.
Section 4. Reduction in Lot Area or Yard Requirements
I, No lot shall be reduced in area so that yards, lot area
per family, lot width, building area, or other requirements'of this
ordinance are not maintained. This section shall not apply when
a portion of a lot is acquired for a public purpose.
2. ',No yard or - lot area requirements for buildings existing at
the time of the passage of this ordinance shal I be considered as
yard or lot area requirements for any other building.
Section 5. Zoning of Annexed Territory
Al! territory which may hereafter.be annexed to the City shall be
governed by an,d subject_to the requirements of R -IA Single Family
Residential D'i`'tr.ic.t until such time a's the Zoning D r ictMap shell
havebeen amended to authorize other„use or uses for the newly annexed
territory.
Section 6. Off-street Loading and Unloading Space
Every building or structure hereafter constructed for commercial or
industrial uses shall provide adequate space for the loading and
• uriloadtng.,of vehicles off the street or.pubIicalley. The adequacy
• of such space shalL be determined by the City Building Inspector.
Section 7. Off—str,eet.Park'ing, Requirements
I. .There shall be provided permanent off= street parking space
as Feg6ired in this ordinance at the time of erection of'any building
or structure or at the time any principal building or structure is
enlar'ged.or increased in capacity by adding dwelling units, guest
rooms, seats.or-floor area, or before conversion from one zoning use
or occupancy to another. Vehicular access shall be provided to a
public street or alley,
.Any off—street parking area already in use or established hereafter
shall not be reduced below the limits required by this section by
the construction of any addition to a building or structure nor by the
erection of au additional building or structure on the property.

a. Residential off-street'park'ing requirements --
(I) Dwellings.-- single, two-family, and multi -family.
One (I) parking spaceshellbe provided on the
premises for each dwelling or family unit. The

shall be provided for each three hundred (300) square
feet of total floor area exclusive of basement or storage

h. Wholesale houses and warehouses-- One (I) parking space
for each three employees shall be provided, based on
maximum seasonal employment.
1. Service stations-- A minimum of five (5) feet for a
safety zone and ten (10) feet for a service driveway
shall be provided between the street right-of-way
line and the nearest part of the service station pump
island or building.
j. Industrial and manufacturing establishments-- one (I)
parking space on the premises shall be provided for
each three (3) employees, computed on the basis of the
greatest number of employees on duty at any time. In
addition there shall be provided vehicle storage or
standing space for all vehicles used directly in
the conduct of such industrial use.
2. Parking space maintained in connection with an existing and
continuing main building or structure on the effective date of this
ordinance up to the number required by this ordinance shall be
continued and may not be counted as serving a new structure or additior
nor may any parking space be substituted for a loading space, nor any
loading space substituted for a parking space.

or structures shall not be permitted within fifteen (15) feet of any
intersecting street corner.

ARTICLE V: PROVISIONS GOVERNING ZONING DISTRICTS
Section I. R- IA Single Family Residential District
This district is intended to include those quiet residential areas
for single family homes on spacious lots.
I. Uses Permitted
a. Residential uses-- only one single family residence
shall be permitted on each lot.
b. Accessory building uses-- accessory buildings, such as
a garage, servant's quarters, or guest house, provided
the building is occupied by servants employed on the
premises or by guests, and are not occupied otherwise
as rental units by non -servant or non -guest occupants.
c. Advertising signs--
• (I) Real estate-- temporary sale, rental or lease signs,
• not more than, eight square feet in area and located
at least ten feet 'from a street or lot Ii.ne.
(2) Subdivision development-- temporary, unilluminated
signs advertising subdivisions, not exceeding
forty (40) square feet in area nor more than ten
(10) feet in height; such sign shall be set. back in
conformance with the front yard set -back of the
district in which it is located, and shall be
removed within a period of three (3) years.
(3) Building construction-- only one temporary and
unilluminated sign of contractor, architect,: or
owner, not more than sixteen (16) square feet In
area, for the period of construction only.
2. Uses Permissible on Appeal to Board of Adjustment
a. Public and private uses-- public and parochial schools,
fire stations community buildings, water supply reser-
voirs, wells and filter beds, public parks and publicly
owned recreation facilities, other municipal, county,

Zoning District Map, construction of which would have been permitted
under the zoning ordinances or the amendments thereto which were in

occupancy and an intensity of land use no higher and a standard of
open space no lower than that permitted by this ordinance in the
district in which the proposed project is located. However, in no
case shall the Board of Adjustment authorize a use prohibited in the
district in which the project is located,, or a smaller lot area per
family than the minimum required in such district or a greater height
or a larger coverage than the requirements of this ordinance permit

remodeling and alteration or rebuilding of nonconforming residential
uses within these districts, such remodeling and alteration is
permissible on appeal if in the opinion of the Board of Adjustment,
continued residential use of the property does not constitute an
unreasonable health hazard to the occupants and avoids unreasonable
economic losses.
Section 5. Property Rezoned for Commercial Uses
Any lot or lots which were rezoned for commercial uses by action of
the City Council within one (I) year prior to the adoption of this
Ordinance shall continue as rezoned, provided that a building permit
is obtained within one (I) year for any construction and development
permitted by the rezoning and that such construction and development
is completed within two (2) years after the adoption of this ordinance.
Section 6. Setback Lines forSigns before Street Widening
Buildings, structures (signs), yards and official setback lines
are defined in Article Ii, 3 and 28. However, with respect to
ground signs, the setback measurements for such signs may be based
on the existing private property line, if the street widening or
alterations are not completed, rather than on, the official setback
line as determined by the Major Street Plan. If a gr.ound sign is
to be erected at an intersecting street, such sign shall not be
located within fifteen (15) feet of any existing property lines on
that intersecting street corner. After a street is widened in
accordance with the requirements of the Major Street Plan, all signs
shall be located in conformance with the official setback line, with
the owners bearing all expenses involved in the relocation of such
signs.

ARTICLE VII ENFORCEMENT
Section I. Enforcing Officer
The provisions of this ordinance shall be,administered and enforced
by a Building Inspector appointed by the mayor;.and city council who
shall have the power to make inspection of buildings or premises
-
necessary to carry out his duties in the enforcement of this ordinance.
Section 2. Building Permits and Certificates of Occupancy
I. Building Permit Required
It shall be unlawful to commence the excavation for the construction
of any building, including accessory buildings, or to commence
the moving or'alteration of any building, including accessory
buildings, until the Building Inspector has issued a building permit
for such work.
2. Issuance of Building Permit
When applying to the Building Inspector for a building permit, the
applicant shall submit a*plat and/or plans in duplicate drawn to
scale, showing the actual dimensions of the 'lot to be built upon, the
size, height, and location on the .lot• of all buildings to be erected,
altered, or moved and of any building already on the lot. The
applicant shall also state the existing and intended use of all such
buildings and supply such other:information as maybe required by
the Building -Inspector -for determining whether the provisions of this
ordinance are being observed.
If the proposed excavation is in conf.ormity with the provisions
of this ordinance and with other ordinances of the City of
Fayetteville now in force, the Building Inspector shall issue a
building permit for such excavation or construction. -If a building
permi't•is refused, the Building Inspector shall state such refusal
in writing, with cause.
a. The issuance of a permit shall in no case be construed
as•waiving any provision of this ordinance.
b. A building permit shall become void six months from the
date"of issuance unless work has been started on the
project described therein.

c. A building permit shall become void twenty-four (24)
months from the date of issuance unless the construction
work has been completed and a cer.ti.ficate; of occupancy
has been issued on the property described therein.
3. Certificate..of Occupancy
I
A certificate of occupancy shall be applied for, coincident with
the application for a building permit and shali be issued within
ten (10) days after the erection or structural alteration of such
building has been completed in conformity with the provisions of
these regulations. If such certificate is refused,•the building
•inspector shall state such refusal in writing with the cause.
No land or building or part' thereof hereafter erected or` altered
in its use or structure shall be used until the building,inspector
shall have issued a certificate of occupancy stating that such
land, building; or part thereof, and fhe proposed use thereof; are
found to be in conformity with, the provisions of this ordinance or
other ordinances of the City.
4. Records..
A complete record of all certificates, plats and plans shall be
maintained in the office of the building inspector for inspection
or use by the public. Copies reproduced at the applicants expense,
shall be furnished on request to any person having a proprietary•
or tenancy interest in the building affected. A fee of one dollar
($1.00) shall' be charged for an original certificate of occupancy
and fifty cents (50/) for copies of any original certificate of
occupancy.
Section 3. Violation Penalty •
Any person, firm, or corporation violating or not complying with any
provision of -this ordinance shall be guilty of a misdemeanor and upon
conviction shall -be fined not less than twenty—five dollars ($25.00)
nor more. than one thousand dollars ($1,000.00). Each day such
violation exists shall constitute a separate offense.

ARTICLE VIII BOARD OF ADJUSTMENT
Section I. Creation and Appointments.
This ordinance provides for a Board of Adjustment.in accordance
with Act 186 of the 1957 General Assembly. The Board of Adjustment
shall consist of five (5) members, one of whom may be a member of
the planning commission, to be appointed by the Mayor and confirmed
by the City Council. All members of said Board shall serve without
pay. The term of membership shall be five years. Vacancies shall
be filled for the unexpired term of any member in the same manner
as original appointments.
The board shall meet and organize annually to elect its own chairman
and vice-chairman, each of whom shall serve for one year or until
his successor is duly qualified. The Mayor shall appoint a secretary
who shall hold office during the will and pleasure of the Mayor
and who shall receive such compensation from the City of.Fayetteville
as may be fixed from time to time by the City Council of the City
of Fayetteville,`
Section. 2. Procedure
Meetings of the Board of Adjustment shall be held at such times and
at such places within the City as the Board may designate, or at the
call of the chairman, But the Board shall have at least one meeting
each month.
All meetings shall be open to the public. The Board shall keep
minutes of its proceedings showing the vote of each member upon each
question or, if a member is absent or fails to vote, noting such
fact. The Board shall keep records of its examinations and other
official actions, all of which shall be immediately filed in the
office of the Building Inspector and shall be a public record.
The presenceof three (3) members shall be necessary to constitute
a quorum and the concurring vote of at least three -fifths 3/5
of the members of the Board shall be necessary Vo reverse any order,
'requirement, decision, or determination of any administrative officer
or to decide in favor -of the. application on any matter upon which it
is required to pass under the zoning.ordinance or to effect any
variation in such regulations.
The Building Inspector or his.representative shall attend each meeting
of the Board and shall make available all plans, specifications,
plats and papers, relating to any case before the'Board for considera-
tion,

Section 3. Appeals or Variances
Any appeal or application for variance%to' the Board of Adjustment
may be token 'by any person, firm or corporation aggrieved, or. by
any governmental officer, departmetit; board or bureau affected by
any decision of the building inspector based in whole or in part upon
the provisions of this ordinance.
The Board of Adjustment shall publish a notice of the time and place
.of a public hearing upon such appeal or application for variation;
such notice shall be published at least once not less than ten (10)
days preceding the date of such hearing in an official paper or
newspaper of general circulation in Fayetteville, such notice to
contain the particular location for which the appeal or variation is
requested as well as a brief statement of what the proposed appeal
or variation consists of. A sign three (3) feet wide and four (4)
feet high shall be placed upon the property by the Building Inspector
giving the date and place of the public hearing and what the appeal
or variance consists of, fifteen (15) days before the date of public
hearing. The Board shall also give notice of such hearing to
interested persons and organizations as it shall deem feasible and
practicable. Upon the date of the hearing any party may appear before
the Board in person or by attorney.
The applicant shall be required to pay a filing fee of ten dollars
($10.00) to cover the cost of publishing and mailing notices and
such other expenses as maybe incurred in connection with such appeal
or application.
Section 4. Expiration of Permits
I. No order of the Board permitting the erection or alteration
of a building 'shall be valid for a period longer than sixty (60)
days unless a building permit for such erection or alteration is
obtained within such period and -such erection or alteration is
started and proceeds to completion in accordance with the terms of
such permit.
2. No order of the Board permitting a use of a building or
premises shall be valid for a period longer than sixty (60) days
unless such use is established within this period; provided, however,
that where such use permitted is dependent upon the erection or
alteration,of a building, such order shall continue in force and
effect, if a building permit for said erection or alteration is
obtained within such period and such -erection or alteration is started
and proceeds to completion in accordance with the terms of the permit..
Section 5. Powers
The Board, of Adjustment shall have the following powers:

I. Administrative Review
To hear and decide appeals where it is alleged by the appellant
• that there is an error in any order, requirements, permit,•decision,
determination or refusal made by the building inspector or other
administrative official in the carrying out or enforcement of any
provision of this ordinance.
2. Special Exceptions
To

decide
applications
for special
exceptions
upon which
the
Board
of
Adjustment
is
specifically
authorized
to
pass.
3. Variance
To hear and decide applications for variance from the terms of this
ordinance in cases where a specific piece of property characterized
by exceptional narrowness, shallowness, or shape was a lot of
record at the time of adoption of this ordinance; or where, by
reason of exceptional topographic conditions or other extraordinary
or exceptional situations or conditions of a piece of property, the
strict application of the provisions of this ordinance would result
in exceptional practical difficulties to or exceptional hardship
upon the owner of such property; provided that such relief may be
granted without substantial detriment to the public good and without
substantially impairing the intent and purpose of this ordinance
as specifically authorized in Article VI, Section I and 3.
Section 6. Appeal from Decision of the Board
• Appeal from a decision of the Board of Adjustment shall be to a court
of record having jurisdiction within thirty days from the date of
the decision of the Board.
I. In granting a variance the Board may attach thereto•such
conditions regarding the location, character and other features of the
proposed building, structure or use as it may deem advisable in
furtherance of the purpose of this ordinance.
2. _Before any variance is granted it shall be shown that special
circumstances are attached to the property which do not generally
apply to other property in the neighborhood.

ARTICLE IX AMENDMENT
The City Council may'from time to time amend this Ordinance. Members
of the City Council or any other official or person may petition
for an amendment to fhe Ordinance, which petition sh'all.first be
submitted to the Planning Commission for its .report and recommendations:
I. Amendment Procedure for Private Parties.
a:_. Fee. Any private party or parties desiring a zoning.
change shall pay a fee of $25.00 to the City Treasurer
to cover the costs of public notices and related expenses.
Petition. Any private pa"rty.or pert les desiring an
amendment to the ordinance, upon payment of the above
fee, shall submit to the Planning Commission a petition
giving the ►egad description of the property involved
and the zoning classification requested for the property.
The petition shall also include a statement and diagram
explaining why the proposed changes will not conflict
with surrounding land uses,
c. Public hearing. Upon receipt of a petition for an
amendment, the Planning Commission shall hold a public
hearing on the proposed:amendment, after:'
• I) publishing a notice in a newspaper of general
circulation ,in .the city at least one time fifteen
(15) days prior to the .pub.lic hearing, setting forth
• the time and place of such hearing and the amendment
proposed;
2) posting a sign three (3) feet by four (4) feet in
size at a conspicuous place on the property, fifteen
((5) days prior to the date of the public hearing
and on which is set forth the date and place of the
hearing and the amendment proposed..
d. Action by Planning Commission. Following the public
-.hearing the proposed amendment may be approved as presented
or in modified form by a majority vote of the Planning
Commission and recommended for adoption by. the City
Council, with the reasons for such recommendation stated
in writing• .
If the Planning Commission disapprove a proposed amendment,
fhe reasons for such disapproval shall be given in
writing to the petitioner.
If the Planning Commission neither approves nor disapproves
a proposed amendment within forty—five (45) days after
receipt of a petition for amendment, the action on such
amendment by said -Planning Commission shall be deemed
favorable,

e. Action by the City Council. TheCityCouncil, by
majority vote, may by ordinance adopt the recommended
amendment submitted by the Planning Commission or may
return the proposed amendment to the Planning Commission
,for further, study and recommendation.
If the City Council does not concur with the recommendation
of the.Planni-ng Commission, either as first submitted
or assubmitfed after restudy, the City Council may,
by a• maJorIfy vote] amend. this Ordinance by granting
the origirial request. for amendment in full or
modified form.

petitioner may,appeal ;uch disapproval to the City Council,
provided that th"r petitione'r'states specifically in
writing to the Cfty Clerk why, he considers the Planning
Commission's findings and decisions are {n error.
Such appeal shall be filed with the City Clerk within
fifteen (15) days from the date of the Planning Com�
mission action.
g. Re -petitions for amendments. No application for zoning
amendrn¢n s will be considered by the Planning Commission
within twelve.(12) months from date of final disapproval
of a proposed amendment unless there is evidence submitted
.to the Planning Commission which justifies reconsidera-
tion.
2. Amendment Procedures for Members of the City Council

the Ordinance, such proposals shall' be referred by resolution to the
Planning Commission for study and recommendations. Following
public hearing as provided for in Ic above, the Planning Commission
and City Council shall act in accordance with the procedures set

in conflict herewith including but not limited to the following
ordinances are hereby repealed;
Ordinance Nos. 1002, 1005, 1008,'1037, 1049, 1077, 1079, 1081, 1087,
1090, 1095, 1097, 1117, 1139, 1148, 1157, 1158; 1163, 1181, 1195, 1199.
1200, 1201,.1206, and 1238.
Section 2. Severability
If any section, clause, provision or part of this ordinance shall
be held invalid or unconstitutional by any court of competent
jurisdiction, such section, clause, provision or pert shall be
deemed severable and separable, and the remainder of this ordinance
shall be and remain in full force and effect. It is• hereby declared
to be the intent of the City Council that this ordinance would
have been passed and adopted had.such invalid or unconstitutional
provisions, if any, not been included herein.
