L AN ORDINANCE AMENDING ZONING ORDINANCE N0 . 1008 APPROVED OCTOBER 22 , 19512 REZONING AND •ADOPTING BY REFERENCE THERETO ZONING ORDINANCE NO . 1002 APPROVED SEPTEMBER 10, 1951, AS AMENDED BY ORDINANCE NO . 1005 APPROVED OCTOBER 8 , 19519 AS AMENDED TO REZONE CERTAIN RE9L ESTATE FROM ZONE A RESIDENTIAL DISTRICT TO ZONE E COMMERCIAL DISTRICT. - WHEREAS, a public hearing was held . be£ore the Planning Commission of the City of Fayetteville , Arkansas , on April 14, 1960 on the Petition of J. C . Cox and Carole E. Cox, husband and wife , requesting that ' said Planning Commission re- commend to the City Council of the City of Fayetteville, Arkansas , that said City Council enact an ordinance re-zoning that portion of the following described real estate located in the City of Fayetteville, Arkansas , _ not presently zoned as E Commercial District from Zone A residential District to Zone E Commercial District, to-wit : Part of the Northwest quarter of the Northwest quarter of Section teri7.(10) , Township sixteen ( 16 ) North, of Range thirty ( 30 ) West ; being more particularly described as : Beginning at a . point three hundred sixty-five (365 ) feet West of the North Fast corner of the said Northwest quarter of the Northwest quarter of Section 10 , Town- ship 16 North, of Range 30 West ; thence West four hundred twenty-seven and five-tenths ( 427 .5 ) feet to the East boundary line of United States Highway #71; thence Southwesterly along said highway boundary line two hundred seventy-seven and ninety-eight hundredths ( 277 .98 ) feet ; thence East two hundred twenty-five and four hundredths ( 225 . 04 ) feet; thence South one hundred ninety- seven and forty-three- hundredths ( 197 .43 ) feet ; thence Fast two hundred fifty-five and five tenths ( 255 .5 ) feet ; thence North four hundred forty and three tenths ( 440.3 ) feet ; thence West ten ( 10 ) feet ; thence North ten ( 10 ) feet ; thence East ten (10 ) feet ; thence North twenty ( 20 ) feet to the place of beginning , containing five ( 5 ) acres, more or less . ; and, WHEREAS , a notice of said public hearing , setting forth the time, place , and purpose thereof was published in the Northwest Arkans Times , a newspaper of general circulation in said City, more than fifteen ( 15 )°� or to said public hearing, and WHEREAS, following said public hearing, said Planning Commission certified to the City Council of the City of Fayetteville, Arkansas , its recommendation that an ordinance be adopted rezoning that portion of said above described real estate not presently zoned as E Commercial District from Zone A Residential District to Zone E Commercial District, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS : Section 1.
