ORDINANCE NO. 1229
AN ORDINANCE AUTHORI ?ING, DIRECTING, AND EMPOWERING THE MAYOR AND CITY . ,
CLERK OF THE> CIT.Y OF FAYETTEVILLE , ARKANSAS , TO ENTER INTO A CONTRACT
WITH •BEAVER DAM !'LATER DISTRICT FOR WATER STORAGE RIGHTS AND DECLARING
AN EMERGENCY ,
WHER'T AS , the U. S . Corps of Engineers , Department of the Army, United States
of America, is in the process of constructing Beaver Dam Reservoir and
Beaver Dam
on the White River in the State of Arkansas ; and
WHEREAS , Beaver Dam Water District has been duly organized as a public ,
non-profit regional water 'distribution district under Act No , 11A of the 1957 Acts of the
General"Assernbly .of Arkansas with full power to acquire title to water stored in
said reservoir and water storage and withdrawal rights and to sell .and distribute such
water to municipalities ; 'and-
.WHEREAS , the City of -Fayetteville . Arkansas , has an urgent need of an additional
supply and quantity of. water and said need will increase in. tine future; and
WHEREAS , in order. that Beaver Dam Water District may acquire water storage t
rights in said reservoir- for the .benefit of the City of Fayetteville and other participating
cities , it is necessary that the 'City of .Fayetteville contract with said District to pay
its proportionate shar.e . of said water , storage rights; - and
a WHEREAS, the City of Fayetteville , acting through its duly elected City Council ,
and the Board of• Directors of Beaver Dam Water District, have agreed upon the
teras and conditions upon which the said City shall purchs se water storage rights
from said District;
. NOW, THEREFORE , .BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section'l . That ;he, Mayor and City' Clerk be and they are hereby authorized,
directed and empowered 'to execute a contract for water otorage rights fron Beaver
Dam, Watef. District with the . Board of Directgrs of said District , a true and correct
copy of which contract shall be , set forth in the minutes of the proceedings of the
Fayetteville City. , Council.
Section 2 . That it is hereby ascertained and declared that in order to protect
the health, . lives , and property of the inhabitants of the City , it is necessary to
obtain a.�s adequate and abundant supply of fresh , . wholesorne water , and in order to
obtain su� !, supply, to contractfor storage rights of said water prior to completion .
of Beaver Da:.� ; therefore, an emergency exists and this crdinen _ e , being necessary
for the preservation of the public peace , health and welfare , shall tate effect and
be in force from and after its passago .
