AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT BEAN THE ST. IAUIS-SAN FRANCISCO
RAILWAY COMPANY AND THE CITY OF FAYETTE9ILLE, ARKANSAS, COVERING THE EXCAVATING FOR LAYING,
CONSTRUCTION, MAINTAINING , OPERATION AND REPAIRING OF CERTAIN WATER MAINS AND/OR WATER
LINES CROSSING UNDER THE RIGHT OF WAY AND TRACKS OF SAID RAILWAY COMPANY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS;
SECTION 1. That the Mayor, J: Austin Parish, and City Clerk , George J. Davis , be .
and they are hereby authorized to execute agreements with the St . Louis-San Francisco
Railway Company dated October 15 , 1959 and October 160 1959 covering the excavating for,
laying, constructing, maintaining, operating , and repairing of water mains and/or water
lines crossing under the right of way and tracks of said railway company, said crossings
to be at the following described locations :
An eight ( 8 ) inch water main crossing of the St . Louis-San Francisco Railway
Company right of way at Sycamore Street in the City of Fayetteville, Arkansas,
said crossing being also described by St. Louis-San Francisco Railway Company
as Milepost 351 plus 9 poles plus 91 feet .
A six ( 6 ) inch water main crossing of the St. Louisan Francisco Railway
Company right of way at Cato Springs Road in the City of Fayetteville, Arkansas,
said crossing being also described by 'St . Louis-San Francisco Railway Company
as Milepost 353 plus 24 poles .
A one ( 1 ) inch water line crossing of the St . Louis-San Francisco Railway
Company right of way near the Fayetteville Municipal Airport ( located approximately
four miles South of the present corporate limits of the City of Fayetteville,
Arkansas ) said crossing being also described by St . Louis-San Francisco Railway
Company as Milepost 357 plus 103/4 poles .
SECTION 2 . That all ordinances and parts of ordinances in conflict with this
ordinance are hereby repealed and this action being necessary for the public health,
safety , order , comfort and convenience within the City of Fayetteville, Arkansas , an
emergency is hereby declared to exist and this ordinance shall be in full force and
effect from and after its passage anda proval .
