TRAFFIC CLERK OF THE CITY OF 'FAYETTEVILLE, ARKANSAS, PRESCRIBING DUTIES , FIXING SAIARY, AND FOR 01HER PURPOSES% f�� &AnENDEA BE IT ORDAINED BY THE CITY COUNCIL OF. THE CITY OF FAYETTEVILLE, ARKANSAS 1 . That there is hereby created the office of traffic clerk .whose ssaa]aa hall b�, � . 2 . That the traffic clerk shall be appointed by the Mayor subject however to the consent and approval of the Fayetteville City Council. That the traffic clerk shall exercise the powers and duties as provided in this ordinance and in addition thereto shall perform the duties of municipal court clerk as is now or shall hereafter be prescribed by law. 3 . The traffic clerk shall assist the Judge of the Fayetteville Municipal Court with the clerical work of traffic cases . The office of the traffic clerk shall be open from 9 : 00 o ! clock A .M. until 12100 Noon and from 1 : 00 o1clock P.M. until 5 : 00 o ' clock P.M. on Mondays through Fridays and from 9 : 00 o ' clock A .M. until 12 : 00 o ' clock Noon on Saturday each week except upon legal holidays . .4 . The Judge of the Fayetteville Municipal Court shall designate the specified offenses under the traffic ordinances of this city and the state traffic' laws in respedt to which payments of fines may be accepted by the traffic clerk in satisfaction thereof, and shall specify by suitable schedules the amount of such fines for first , second, and subsequent offenses , provided such fines are within the limits declared by law or ordinance, and shall further specify what number of such offenses shall require appearance before the Municipal Judge and the required amount of bail for. such offenses . 5 . Any person charged with an offense for which payment of a fine may be made to the traffic clerk shall have the option of paying such fine within the time specified in the notice of arrest to the 'traffic clerk upon entering a pleaof guilty and upon waiving appearance in court; or may have the option of depositing required lawful bail and upon_ a plea of not guilty shall be entitled to a trial as authorized by law. The payment of a fine to the traffic clerk shall be deemed an acknowledgment of conviction of the alleged offense , and the traffic clerk, shall issue a receipt to the violator acknowledging payment^thereof . 6 . The following duties are hereby imposed upon the traffic clerk in reference to traffic offenses : (a ) He shall accept designated fines;' issue receipts , and represent in court such violators as are permitted and desire to ,plead guilty and waive court appearances . (b ) He shall: receive and issue receipts for cash bail from the persons who must or wish to be heard in court , enter the time of their appearance on the court docket , and notify the arresting officer and witnesses, if any, to be present . ( c ) He shall keep an easily accessible record of all violations of which each person has been guilty during the preceding 12 months , vhether such guilt was established in the court or by plea of guilty, waiver of appearance and payment of fine to the traffic clerk . (d ) He shall keep records and submit summarized monthly reports to the Judge of the Fayetteville Municipal Court of all noticesissued and arrests made for violations of the traffic laws and ordinances of this city and of all. the fines collected by him, and of the final disposition or present status of every case of violation of the provisions of said laws and ordinances . Such records shall be so maintained as to show allt es of violations and the totals of each . Said records shall be public records . MICR ofd is75 DATE�� REEL1 5 7 . The traffic clerk shall exercise the powers and duties as provided in this ordinance and in addition thereto shall perform the duties of Clerk of the Fayetteville Municipal Court as same are now prescribed by Sections 22-713 and. 22-719 of Arkansas Statutes of 1947, Annotated , or as shall hereafter be prescribed by law.- 8 . aw:8 . The traffic clerk, before entering upon the duties of said office , shall make and file with the City Clerk a good and sufficient bond for the faithful performance of his duties as traffic clerk and as Clerk of the Fayetteville Municipal Court in the sum of $73500 . 00; said bond to be approved by the City Council and the premium therefor , if a surety bond be approved, to be charged as an expense of operating said municipal court . 9 .
