AN ORDINANCE VACATING AND ABANDONING PORTIONS OF CERTAIN UNOPARL
STREETS IN EVELYN HILLS ADDITION TO THE CITY OF FAYETTEVILLE, RK
WHEREAS , a petition was duly filed with the City Council of the City '
of Fayetteville , Arkansas , on the 8th day of June , 1959 , asking the City
Council to vacate and abandon all that portion of Willow Avenue between
Abshier Drive and Woodcrest Drive and all that portion of Woodcrest Drive
between U . S . Highway No. 71 and Hillcrest ( originally platted as Walnut)
Avenue, as designated on the plat of Evelyn Hills Addition to the City of
Fayetteville, Arkansas , now appearing of record in Plat Book No. 2 at page
61 thereof in the office of the Recorder of Washington County, Arkansas.
WHEREAS, after due notices as required by law, the Council has, at the
time and place mentioned in the notice, heard all persons desiring to be
heard on the question and has ascertained that the portions of said streets
hereinbefore described have heretofore been dedicated to the public use
and have not been actually used by the public generally for a period of
at least five years subsequent to the filing of the plat; that all the
owners of the property abutting upon the portions of said streets to be
vacated have filed with the Council their written consent to such abandonment;
and that public interest and welfare will not be adversely affected by the
abandonment of such portions of such streets .
NOW, THEREFORE, BE. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS :
Section 1 : The City of Fayetteville, Arkansas , hereby releases , vacates
and abandons all its rights , together with the rights of the public generally,
in and to all that portion of Willow Avenue between Abshier Drive and Wood-
crest Drive and all that portion of Woodcrest Drive between U. S . Highway
No. 71 and Hillcrest (originally platted as Walnut) Avenue, as designated
on the plat of Evelyn Hills Addition to the City of Fayetteville, Arkansas,
now appearing of record in Plat Book No. 2 at page 61 thereof in the office
of the Recorder of Washington County, Arkansas.
Section 2 : A copy of this ordinance duly certified by the City Clerk
shall be filed in the office of the Recorder of Washington County, Arkansas,
and recorded in the deed records of said county.

Section 3s That all ordinances and parts of ordinances in conflict
with this ordinance are hereby repealed and this action being necessary
for the public health, peace, safety, order, comfort and convenience within
the City of Fayetteville, Arkansas, an emergency is hereby declared to exist
and this ordinance shall be in full force and effect from and after its
passage and approval.
