ZONING ORDINANCE NO. 1002 APPROVED SEPTEMBER 10, 1951 , AS AMENDED
BY ORDINANCE NO. 1005 APPROVED OCTOBER 8 , 1951 , AS AMENDED: TO
REZONE CERTAIN REAL ESTATE FROM ZONE A- RESIDENTIAL DISTRICT" TO
ZONE E- COMMERCIAL DISTRICT, AND TO REZONE CERTAIN REAL ESTATE
FROM ZONE A- RESIDENTIAL DISTRICT TO ZONE C - RESIDENTIAL DISTRICT ,
AND TO CHANGE THE HEIGHT RESTRICTION OF ZONE E- COMMERCIAL DIST-
RICT TO PERMIT THE CONSTRUCTION OF OFFICE BUILDINGS THEREIN UP
TO AND INCLUDING 5 STORIES IN HEIGHT .
WHEREAS, a public hearing was held before the Planning Commission
of the City of Fayetteville, Arkansas , on May 5 , 1959 , on a proposed ordinance to
rezone all that portion of Lots numbered 1, 2 and 3 , Block numbered 1 in Evelyn
Hills Addition to the City of Fayetteville, Arkansas , presently zoned as zone A-
Residential District to zone E- Commercial District, and to rezone Lot numbered
12, Block numbered 1 in Evelyn Hills Addition to the City of Fayetteville, Arkansas ,
from zone A- Residential District to. zone C211esidential District, and to change the
height restriction in zone E- Commercial Districts to permit the construction of
office buildings therein up to and including five stories in height :
and,
WHEREAS, a notice of said public hearing setting forth the time, place
and purpose thereof was published in the Northwest Arkansas Times , a newspaper
of general circulation in said City, more than 15 days prior to said public hearing,
and
WHEREAS, t?? :: following said public hearing said Planning Commission
certified to the City Council of the City, of Fayetteville, Arkansas its recommendation
that an ordinance be passed rezoning that portion of Lots 1, 2 and 3, Block numbered 1 , \
in Evelyn Hills Addition to the City of Fayetteville, Arkansas , presently located
in zone A- Residential District to zone .E- Commercial District, and rezoning Lot
numbered 12 , Block numbered 1 , in Evelyn Hills Addition to the City of Fayetteville ,
Arkansas , from zone A- Residential District to zone C- Residential District, and
changing height restrictions of zone E- Commercial Districts to permit the construct -
ion of office buildings therein up to and including five stories in height,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS :
Section 1 . That all of that portion of Lots numbered 1 , 2 and 3 , Block
numbered 1 in Evelyn Hills Addition to the City of Fayetteville, Arkansas , presently
located in zone A- Residential District, be, and the same hereby is , rezoned from
zone A- Residential District to zone E- Commercial District ; and that Lot numbered
12, Block numbered 1 , in Evelyn Hills Addition to the City of Fayetteville, Arkansas ,
be, and the same hereby is , rezoned from zone A- residential District to zone
C- Residential District; and that the height restriction in zone E- Commercial
Districts be , and the same hereby is changed to permit the construction of office
buildings therein up to and including five stories in height ,
c Section 2 .2 . That all ordinances and partsof ordinances inammeMOW
with this ordinance are hereby repealed, and this action being necessary for the
public health, peace, safety, order, comfort and convenience within the City of
Fayetteville, Arkansas , an emergency is hereby declared to exist and this ordinance
shall be in full force and effect from and 'after its passage and approval .

The Fayetteville City Planning , C ommis s ion hereby certifies that a
public hearing was held before it on May 5, 1959 , on the Petition of Preferred
Risk Insurance Company, an Arkansas .Corporation, . T . I. Abshier, and
J . F . Palmer, requesting said Planning ;Commission to recommend to the
City of Fayetteville, Arkansas, that said City. Council pass an Ordinance
re - zoning that portion of the following described lands located in the City of
Fayetteville; Washington County, Arkansas, not presently zoned _ as E Commercial
District from zone A- Residential District to zone E- Commercial District, and
changing the restriction of E- Commercial Districts concerning the height of
office buildings to permit the construction of office buildings up to and including
five stories in height :
Lots numbered 1, 2, 3, and 12, Block numbered 1 , in Evelyn
Hills Addition to the City of Fayetteville, Arkansas .
That a Notice of said public hearing setting forth the time , ' place and
purpose thereof was published in the Northwest Arkansas Times , a newspaper
of general circulation in said City, more than 15 days prior to said public
hearing .
That at the close of said public hearing, theif,ubeing a quorum of the
membership of said Planning Commission present, a Motion was duly na de,
seconded and passed that said Planning Commission recommend to the City
Council of the .City of Fayetteville that said City Council pass an Ordinance
re - zoning that portion of Lots 1, 2 and 3 , Block numbered 1 in. .Evelyn Hills
Addition to the City of Fayetteville, Arkansas , not presently zoned 'as E-
Commercial District from zone A- Residential District to zone E- Commercial
District; and rezoning Lot 12 , Block numbered 1 in said addition from zone
A- Residential District to zone C - Residential District; and changing the
restriction of zone E- Commercial Districts concerning the height of office
buildings to permit the construction of office buildings therein up to and
including five stories in height .

mercial District was duly made, seconded and passed.
