AN ORDINANCE AMENDING ZONING ORDINANCE N0, 1008 APPROVED OCTOBER 22 , 1951, REZONING
AND ADOPTING BY REFERENCE THERETO ZONING ORDINANCE N0. 1002 APPROVED SEPTEMBER 10,
19513 AS AMENDED BY ORDINANCE N0. 1005 APPROVED OCTOBER 8 , 19513 AS AMENDED : TO RE-
ZONE CERTAIN REAL ESTATE FROM ZONE A-RESIDENTIAL DISTRICT TO ZONE E-COMMERCIAL DIS-
TRICT .
WHEREAS , a public hearing was held before the Planning Commission of the City
of Fayetteville , Arkansas on May 5, 1959 on a proposed ordinance to rezone the following
described land located in the City of Fayetteville , Washington County, Arkansas not
presently zoned as Zone E-Commercial District from Zone A-Residential District to
Zone E-Commercial District :
All of Block 5 and the West half of Block 4 in Evelyn Hills Addition to
the City of Fayetteville, Arkansas together with a tract of unplatted
land in said City North of said Evelyn Hills Addition being Part of the
South half of the Northwest Quarter of the Northwest Quarter of Section
ten ( 10) in Township Sixteen ( 16) North of Range Thirty (30) West , des-
cribed as follows : Beginning at a point 352. 9 feet West and 50 feet North
of the South Fast corner of said twenty acre tract, and running, thence
North 610 feet; thence South 890552 ' West 563 .7 feet , more or less to
the East line of Highway No. 71 Right-of-Way; thence in a Southwesterly
direction with the East line of said highway 71 right-o£-way approximately
625 feet to a point in the East line of Right-o£-way which is 50 feet North
of the South line of said twenty acre tract; thence East 740 feet , more
or less to the place o£ beginning.
and,
WHEREAS, a notice of said public hearing setting forth the time , place and
purpose thereof was published in the Northwest Arkansas Times , a newspaper of general,
circulation in - said City, more than 15 days prior to said public hearing, and
WHEREAS , following said public hearing, said Planning Commission certified to
the City Council of .the City of Fayetteville , Arkansas its recommendation that an
ordinance , be passed rezoning that portion of the above described tract of land not
presently zoned as Zone E-Commercial District from Zone A-Residential District to Zone
E-Commercial District,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS :
Section 1 : That the following described real estate situated within the cor-
porate limits of the City of Fayetteville, Washington County, Arkansas , not presently
zoned as Zone E-Commercial District, be , and the same hereby is , rezoned from Zone A-
Residential District to Zane E-Commercial District, to-wit :
All of Block 5 and the West1 half of Block 4 in Evelyn Hills Addition to
the City of Fayetteville , Arkansas together with a tract of unplatted
land in said City North of said Evelyn Hills Addition being Part of the
South half of the Northwest Quarter of the Northwest Quarter of Section

Section 2 ; That all ordinances and parts of ordinances in conflict with
this ordinance are hereby repealed and 'this action being necessary for the public
health , peace, safety, order, comfort and convenience within the City of Fayetteville, .
Arkansas , an emergency is hereby declared to exist and this ordinance shall be in
full force and effect from and after its passage and approval.
