AN ORDINANCE AMENDING ZONING ORDINANCE N0. 100 , APPROVED OCTOBER 22, 1951, REZONING
AND ADOPTING BY REFERENCE THERETO ZONING ORDINANCE N0. 1002 , APPROVED SEPTEMBER 10,
19$1; .AS AMENDED BY ORDINANCE N0 . 1005, APPROVED OCTOBER 8, 1951, AS .AMENDED, TO
ENABLE THE CITY . COUNCIL . TO TAKE ACTION UPON PROPOSED CHANGES IN ZONING DISTRICTS
AT ANY REGUTAR OR SPECIAL h=ING, TO PROVIDE FOR THE ZONING OF ANNEXED TERRITORY,
AND FOR OTHER PURPOSES. _
BE IT ORDAINED BY THE CITY COUNCIL OF THE `CITY OF FAYETTEVILLE, ARKANSAS :
Section 1. That Section 22 of Zoning Ordinance No . 1008 , as amended, be and the same
is hereby amended to read as follows, to-mitt
"SECTION 22 . CHANGES AND AMENDMENTS.
The City Council may from time to time, amend, supplement or change
by Ordinance the boundaries of the Districts or the Regulations herein
established . Any proposed amendment, supplement or change shall first be
submitted to the City Planning Commission for its recommendation and report.
A proposed amendment, supplement or change may be initiated by the City
Council nkich shall refer such initiated proposals to the City Planning
Commission for its recommendation and report.
A proposed amendment, supplemm t or change may be initiated by the City
Planning Commission.
A proposed change in a Zoning District may be initiated by one or more
omers or lessees within the area proposed to be changed. Application shall
be filed with the City Planning Commission at least seven ( 7 ) days prior to
the meeting at which the Commission will consider the change.
The City Council may take action on proposed changes in Zoning Districts
at any regular or special meeting of the City Council.
No application for a change in zoning for a given property may be
resubmitted within twelve ( 12 ) months from date of action by the City Council
unless the City Planning Commission finds that a substantial change in conditions
has occurred.
Action by the City Planning Commission and by the City Council shall be
in conformity with the provisions of the Statutes of the State of Arkansas. "
Section 2 . That Section 21 of Zoning Ordinance No. 1008, as amended, be and the same
is hereby amended to read as follows, to-wit :
"SECTION 21.
Territory annexed to the City of Fayetteville shall be goverened by the
following temporary rules and regulations until the zoning map Anall have been
amended to include the newly annexed territory :
(a ) Until the adoption of a laid use plan, the building inspector may
issue permits for any use permitted in any of the abutting zones.
(b ) After adoption of a land use plan, the building inspector shall issue
permits only for uses indicated on the land use plan.
( c ) Nothing herein contained shall require any change in designated use
of a building actually under ' construction at time territory is annexed to
the City of Fayetteville. This does not relieve the individual, firm, or
corporation from securing a bui]ding permit or from the requirements
of a building or construction code. "
Section 3 . That the provisions of this ordinance are severa* and if any part -of this
ordinance shall be declared invalid or unconstitutional, the remaining parts of this
ordinance shall remain valid and constitutional.
Section 4. That all ordinances and parts of ordinances in conflict herewith are hereby
repealed, and it being essential to the orderly development and growth of the City of
Fayetteville, Arkansas, and this action being necessary for the public health, peace,
safety, order, comfort and convenience, within the City of Fayetteville, Arkansas, an
emergency is hereby declared to exist, and this ordinance shall be in full force and
,. effect from and after its passage and approval.

the City Council Room in the City Administration Building on Monday , February 24,
1958 .
