HomeMy WebLinkAboutOrdinance 1153 y ORDINANCE NO, AN ORDINANCE REGULATING SOLICITORS, PEDDLERS, HAWKERS, ITINERANT MER- CHANTS OR TRANSIENT VENDORS OF MERCHANDISE IN THE CITY OF FAYETTEVILLE, ARKANSAS; DECLARING IT TO BE A NUISANCE FOR THOSE ENGAGING IN SUCH PUR SUITS TO GO IN OR UPON PRIVATE RESIDENCES WITHOUT HAVING BEEN REQUESTED OR INVITED TO DO SO; PROVIDING PENALTIES FOR THE VIOLATION THRREOF ; RE - PEALING ALL ORDINANCES IN CONFLICT HEREWITH BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Se^tion 1 . The practice of going in and upon private ,residences in the city of Fayetteville, Arkansas, by solicitors , peddlers , hawkers, itinerant merchants or transient vendors of merchandise not having been requested or invited to do so by the owner or owners , occupant or occupants of said private residences for the purpose of soliciting orders for the sale of goods , wares and merchandise and/ or disposing of and/ or peddling or hawking the same is declared to be a nuisance and punishable as such nuisance as a misdemeanor. Section 2 . Any person convicted of perpetrating a nuisance as described and prohibited in the First Section of this ordinance, s1l a fined in a sum of not less than Ten Dollars ($10 . 00) , nor more than Twenty-Five / R '6D) , together with the costs of the proceeding. Section 3 . That the provisions of this ordinance shall not apply to the sale , or soliciting of order for the sale of fruits, vegetables or other products of the farm, including meat from domestic animals or livestock, so far as the sale of the commodities named herein is now authorized by law . Section 4. All ordinances or parts of ordinances in conflict herewith are herewith and hereby repealed. Section 5. Whereas, the ringing of doorbells by solicitors, peddlers , hawkers, itinerant merchants or transient vendors of merchandise, haSFbecome highly annoying and dis - turbing to the occupants of residential property, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of the public peace , health and safety, the same shall be in full force and effect from and after its passage.
