AN ORDINANCE AMENDING ZONING ORDINANCE NO . 1008 APPROVED OCT -
OBER 22, 1951 , REZONING AND ADOPTING BY REFERENCE THERETO ZON -
ING ORDINANCE NO , 1002 APPROVED SEPTEMBER 10 , 1951 , AS AMENDED
BY ORDINANCE NO, 1005 , APPROVED OCTOBER 8 , 1951 , AS AMENDED : TO
REZONE CERTAIN REAL ESTATE FROM ZONE "C " RESIDENTIAL DISTRICT
TO ZONE "E " COMMERCIAL DISTRICT ,
WHEREAS , The Planning Commission of the City of Fayetteville , Arkansas , has
recommended to the . Fayetteville City Council that the following described real
estate be rezoned from Zone "C " Residential District to Zone "E " Commercial
.
District , to-wit:
The West side of South School Street, Fayetteville , Arkansas , from the
Northeast corner of Block 37 , as designated upon the Original Plat of the. .
town (now city) of Fayetteville , Arkansas , and extending in a Southerly
direction 288 feet , •ar to the North line of the City Hospital lot , of Fayette -
ville . Arkansas , and thence West 160 :eet . thence North 288 feet, and
thence East 160 feet , to the place of beginning .
and,
WHEREAS , pursuant to due notice to all interested parties in the form and manner
required by law , this is the time . place and date fixed for hearing upon the afore -
said recommendation of the City Planning Commission .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE , ARKANSAS :
Section . 1. That the following described real estate situated within the corporate
limits of the City of Fayetteville . Arkansas , be and the same is hereby rezoned
from Zone "C " Residential District to Zone "E" Commercial District to - wit :
The West side of .South School Street , Fayetteville , Arkansas , from the
Northeast corner. of Block 37 , as designated upon the Original Plat of the
town (now city) of Fayetteville , Arkansas , and extending in .a Southerly
direction 288. feet , or, to the North line of the City Hospital lot , of Fayette -
ville , Arkansas , and thence West 160 feet , thence North 288 feet , and thence
East 160 feet , to the place of . beginning .
Section Z . The -provisions of this ordinance are severable and if any part';of this
ordinance shall. be declared invalid or unconstitutional , the remaining parts of
this ordinance shall remain valid and constitutional .
Section 3 . That allordinancesand parts of ordinances in conflict with this ordinance
are hereby repealed_ and this . action being necessary for the public health , peace ,
safety , order , , comfort and convenience within the . City of Fayetteville . Arkansas ,
an emergency is .hereby declared to exist and this ordinance shall be in full force
