AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, COUNTY OF WASHINGTON, STATE OF ARKANSAS, AMENDING ORDINANCE NO . 1028, GRANTING TO THE FAYETTEVILLE BROADCASTING COMPANY, A CORPORATION, ITS SUCCESSORS, LESSEES AND ASSIGNS, THE RIGHT AND PRIVILEGE AND FRANCHISE TO USE AND OCCUPY FOR ITS TELEVISION SERVICE, THE STREETS, AVENUES, ALLEYS, ROADS AND HIGHWAYS, AND OTHER PUBLIC PLACES OF THE CITY, FOR THE PURPOSE OF EREC CONSTRUCTING, OWNING, LEASING, OR OTHERWISE ACQUIRING, MAINTAINING OR OPERATING TELEVISION LINES TO BE USED IN FURNISHING OR SUPPLYING THE IN - HABITANTS OF SAID CITY OR ANY PERSON, FIRM OR CORPORATION WITHIN SAID CITY AND TO OTHERS BEYOND THE LIMITS OF SAID CITY, WITH TELEVISION SIGNALS : AND AUTHORIZING TRANSFER OF SAID FRANCHISE TO TRANS -VIDEO CORPORATION OF ARKANSAS, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, WASHINGTON COUNTY, ARKANSAS : Section 1 . That on the 7th day of July, 1952 , this Council adopted Ordinance No . 1028, granting a franchise to the Fayetteville Broad(casting Company, Inc . , its successors , lessees , and assigns , authorizing the exclusive use of the streets and alleys , and other public places , located in the City of Fayetteville , in order that said company might furnish a direct wire reception of television programs and other services in connection therewith to the citizens of the City of Fayetteville , Washington County, Arkansas . Section 2 . That the said Fayetteville Broadcasting Company, Inc , has heretofore assigned said franchise to Trans -Video Corporation of Arkansas , an Arkansas Corporation, and it is desirable that the assignment of said franchise be approved by this council . Section 3 . That the authority granted in said franchise be clarified in order to include said uses presently being made of the antenna and wire systems of said corporation, and to include any possible further usage of said system in the future by the holder of said franchise . Section 4 . That the franchise heretofore granted to the Fayetteville Broadcasting Company, Inc . , its successors , lessees and assigns, by virtue of Ordinance No . 1028, be and is hereby vested in Trans -Video Corporation of Arkansas , an Arkansas Corporation, the assignee of said Fayetteville Broadcasting Company, Inc . Section 5 . That the above mentioned franchise be clarified and amended to include the trans - mission of all television signals . The term "television signals " for the purpose of this ordinance is defined as the electrical impulses or composite series of electrical information designed to actuate a standard television receiver or any special type of television receiver or monitor , whether this television signal be received from a standard broadcast television station or from relay stations or is originated by any type of television camera or combination of television camera and slide projector or motion picture film projector and camera or any other means whereby visual images are to be reproduced on a television set , including the operation of an electronic home theatre during the existence of this permit or franchise . Rey Section 6 . That Ordinance No . 1028 shall remain in full force and effect save only as ,to the extent same is amended and supplemented as is herein specifically provided . Section 7 . If any section, subsection, sentence , clause or phrase of this ordinance is for any reason declared unconstitutional or invalid, such decision shall not effect the validity of the remaining portions of this ordinance . Section 8 . That this action being necessary for the preservation of public health, peace and prosperity, safety, order, comfort and convenience of the City of Fayetteville, Washington County, Arkansas , and the inhabitants thereof, an emergency is hereby declared to exist, and this ordinance shall take effect and be in force from and after its passage .
