ORDINANCE NO 1138
AN ORDINANCE TO PROHIBIT THE DELIVERY OR TRANSFERRING OF GAS -
OLINE FROM ANY TRUCK, TANK, OR OTHER CONTAINER USED FOR THE
PURPOSE OF TRANSPORTING OR HAULING GASOLINE TO ANY STORAGE
TANK OR OTHER CONTAINER USED FOR THE PURPOSE OF STORAGE OF
GASOLINE , WHETHER SUCH STORAGE TANK OR . OTHER CONTAINER IS SIT -
UATED UNDER OR ABOVE THE SURFACE OF THE GROUND, BETWEEN THE
HOUR'S OF 8 : 00 P . M : AND 5 : 00 A . M . , AND FOR OTHER PURPOSES .
BE IT ORDAINED BY THE CITY COUNCIL OF THE .CITY OF FAYETTEVILLE ,
ARKANSAS .
Section 1 . Gasoline , or any other volatile liquids , shall not be distributed ,
or delivered in wholesale quantities , to any filling station for storage , or sale or
transferred :from one vehicle to another , between the hours of 8 : 00 P . M . and
5 : 00 A . M . , except when such distribution or delivery is authorized by a permit
'issued by the Chief of the Fayetteville Fire Department on appropriate application;
and the Chief of the said Fire Department is hereby authorized to issue such permit .
Section 2 . Any person, firm , corporation'. partnership, or individual
violating any of the provisions of this Ordinance upon conviction thereof, shall be
deemed guilty of a misdemeanor and shall be fined in anysum not less thanTtventy-
'Eve ( $25 . 00) Dollars nor more than Five Hundred ,( $500 . 00 ) Dollars and each act
shall constitute a separate offense .
Section 3 . Ordinance No . 753 , passed and approved on the 17th day of
April , 1933 , be and the same is hereby repealed, and it appearing that the supplying
to the citizens- of the City of Fayetteville of gasoline and gasoline products being
vital to the public peace , health and safety, an emergency is hereby declared to
exist , and this Ordinance shall take effect and be in force from and after its
passage , approval; and publication .
