HomeMy WebLinkAboutOrdinance 1130 a ORDINANCE NO. -2F—� AN ORDINANCE TO AUTHORIZE LEVYING OF ADDITIONAL COSTS IN CONVICTIONS FOR PUBLIC DRUNKENNESS AND DRIVING UNDER THE INFLUENCE OF INTOXICANTS, AND FOR OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTE - VILLE, ARKANSAS : SECTION 1 : That any person upon conviction, in addition to such costs as are now or may hereafter be provided by law, shall be taxed costs as follows : For any conviction on charge of public drunkenness - $1 . 00 For any conviction on a charge of driving while under the influence of intoxicants - - - - - - - - - - - $ 5 . 00 SECTION 2 : That the Municipal Court is so directed and shall tax said costs in all cases arising under violations of City Ordinances or State laws and costs so collected shall be kept in a separate account by the Clerk and accounted for and paid over to the City Treasury at the same time and in the same manner as other Court costs in the first class of accounts as set forth in Section 15 of Act No . 60 of the 1927 Acts of the General Assembly of Arkansas . SECTION 3 : The costs collected under this Act shall be paid into a fund to be used in the purchase , maintenance and operation of equipment designed to test the fact and degree of intoxication of persons arrested on charges of public drunkenness , or driving under the influence of intoxicants , the surplus , if any, after accomplishment of the above purpose , may be used in defraying any other legitimate administrative expenses of the Court . SECTION 4: This Ordinance adopts and is passed with special reference to Act 275 of the 1951 Acts of the General Assembly of Arkansas . SECTION 5 . It is the finding of the City Council of the City of Fayetteville , Arkansas , that some scientific means of determination of the fact and degree of intoxication is necessary to the administration of charges in cases where drunkenness' is an element of the offense and MiCROFILMEQ DATE OCT 9 _ 2 _ that such cases have increased appreciably in the recent past, and this Ordinance being necessary to the administration of justice and for the peace, health and safety of the citizens of the City of Fayetteville, an emergency is hereby declared to exist and this Ordinance shall be in effect immediately upon and after its passage , approval and publications .
