AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT
BETWEEN THE ST . LOUIS - SAN FRANCISCO RAILWAY COMPANY AND
THE CITY OF FAYETTEVILLE, ARKANSAS, COVERING THE EXCAVATING
FOR, LAYING, CONSTRUCTING, MAINTAINING, OPERATING AND
REPAIRING OF AN EIGHT -INCH WATER PIPE LINE CROSSING UNDER
THE RIGHT OF WAY OF SAID RAILWAY COMPANY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS :
Section 1 : That the Mayor, Roy A Scott, and City Clerk, J . W.
McGehee, be and they are hereby authorized to execute an agreement with
the St . Louis - San Francisco Railway Company covering the excavating
for, laying, constructing, maintaining, operating, and repairing of an
eight -inch water pipe line crossing under the right of way of said railway
company .
Section 2 : That all ordinances and parts of ordinances in conflict
with the ordinance are hereby repealed and this action being necessary for
the public health, safety, order, comfort and convenience within the City
of Fayetteville, Arkansas, an emergency is hereby declared to exist and
this ordinance shall be in full force and effect from and after its passage
and approval.
