AN ORDINANCE AMENDING ORDINANCE N0. 1008 APPROVED OCTOBER 22, 1951s REAFFIRMING AND ADOPTING BY REFERENCE THERETO ZONING ORDINANCE N0 . 1002 APPROVED SEPTEMBER 10, 19512 AS AMENDED BY ORDINANCE N0 . 1005 APPROVED OCTOBER 8 , 1951s AS AMENDED, TO MODIFY CERTAIN "E" COMMERCIAL DISTRICT REGULATIONS AND CERTAIN "F" BUSINESS DISTRICT REGULATIONSa BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVIL •F, ARKANSAS : Section 1: That Section 7 , "E" Commercial District Regulations - Use Regulations - of Ordinance No. 1002 , passed and approved September 10, 1951s as amended, be amended to read as follows : "Use Regulations . In the "E" Commercial District. No buildings or premises shall be used and no building therein shall hereafter be erected or structurally altered except for one or more of the following uses : 1. Any use permitted in the "C" Multiple Family Residence District. 2 . Any commercial establishment or place of amusement offering goods or services for sale at retail, not involving the manufacture or treatment of products other than manufacture or treatment which is clearly incidental to the conduct of such retail establishment, and provided that such use is not obnoxious or offensive by reason of the emission of odor, dust, smoke, gas, noise, or vibration, and is not expressly prohibited by any other regulation or ordinance of the City of Fayetteville. 3 . Storage garages. 4. Public garages . 5 . Commercial parking lots. 6. Gasoline filling stations . 7 . Office buildings. 8 . The following wholesale, distributing or jobbing establishments : electrical, radio and television supplies and equipment; automotive parts and accessories; florists and dealers in nursery stocks ; it being the intent of this Section to limit such wholesale usage to establishments which are not obnoxious or offensive by reason of emission of odor, dust, smoke, gas, noise, vibration, and which do not generate heavy truck traffic and extensive loading and unloading operations . " Section 2 : That Section 7 "E" Commercial District Regulations - Yard Regulations - of Ordinance No. 1002, passed and approved September 10, 1951, as amended, be amended to read as follows : MICROFILMED "Yard Regulations . WTE OCT a 1978 REEL �.2-- Front and Rear Yards : All dwellings in the "E" Commercial District hereafter erected or structurally altered shall comply with the front and rear yard regulations �2- of the "B" Residence Districts however that no rear yards shall be required for commercial buildings hereafter erected or structurally altered, except as provided in Section 10. Side Yards : In the " E" Commercial District there shall be a side yard on each side of every building occupied by a use permitted in "C" Multiple Family Residence District of not less than five (5 ) feet. In the event that Section 16 of this ordinance requires a side yard of greater width on the street side of a corner lot than is required herein, the provisions of said Section 16 shall prevail. No side yards shall be required for Commercial buildings hereinafter erected or structurally altered in "E" Commercial District, except as provided in Section 10. " Section 3 : That Section 8 "F" Business District Regulations - Use Regulations - of Ordinance No . 1002, passed and approved September 10, 1954 as amended, be amended to read as follows : "Use Regulations. In the "F" Business District no buildings or premises shall be used and no building therein shall be erected or structurally altered except for one or more of the following uses : 1. Any use permitted in the "E" Commercial District. 2. Any business establishment selling merchandise at wholesale. 3 . Storage warehouses and storage yards . 4. Any kind of light manufacturing, treatment, processing, packaging or repairing which is not obnoxious or offensive by reason of the emission of odor, dust, smoke, gas or noise and which is not expressly prohibited by any other regulation or ordinance of the City of Fayetteville. 5. Trade Schools. Section 4 : All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed and this ordinance being necessary for the preser- vation of the public, peace, health, comfort, convenience, safety and welfare of the City of Fayetteville, an emergency is declared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
