AN ORDINANCE VACATING AN ALLEY RUNNING EAST AND WEST BETWEEN LOT SIX IN BLACK
TWO ADD LOTS THREE, FOUR, AND FIVE IN BLOCK THREE OF A. L. TRENTIS REVISED
PLAT OF MY' PARK ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS.
WHEREAS, a petition was dully filed with the City Council of the City of
Fayetteville,. Arkansas, on the 2d day of May, 1955 , asking the City Council
to vacate and abandon the Fast one hundred seventy-five ( 175 ) feet of a twenty
( 20 ) foot alley running Fast and West between Lot Six ( 6) in Block Two ( 2 ) and
Lots Three (3 ) , Four ( 4) and Five ( 5 ) in Block Three (3 ) of A. L. Trent ' s revised
plat of City Park Addition to the City of Fayetteville, Arkansas, and -
WHEREAS, after due notice as required by law, the City Council has , at the
time and place mentioned in the notice, heard all persons desiring to be heard
on the question, and has ascertained that the portion of the alley- hereinabove
described has kieretofore .been dedicated to the public as an alley; has not been
actually used by the public generally fora period of at least five (5 ) years
subsequent to the filing of the plat; that all of the owners of the property
abutting on the portion of said alley sought to be vacated have filed with the
City Council their written consent to said abandonment; and that the public
interest and welfare will not be adversely. affected by the abandonment of said
alley,
NOW, MiEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS :
Section 1 : That the City of Fayetteville, Arkansas, hereby releases, vacates
and ' abandons all its right , together with the rights of the public generally in
and to the East one hundred seventy-five ( 175 ) feet of a twenty ( 20 ) foot alley
running East and West between Lot Six in Block Two and Lots Three, .Four, and Five
in Block Three of A . L. Trent ' s revised plat of City Park Addition to the City of
Fayetteville, Arkansas , . reserving unto said City of Fayetteville, Arkansas, its
successors and assigns, an easement or right of way on, under, over and across the
portion of said alley hereby vacated, for the purpose of constructing, installing,
laying and relaying , relocating and maintaining all public utilities now located
or which may hereafter be located upon said vacated alley by said City or any
corporation having a fxanchise or right of way from said City.
Section 2 : A copy of the ordinance; duly certified by the City Clerk, shall
be filed in the office of the recorder of the County and recorded in the Deed

Section 3 : This ordinance shall take effect and be in force from and+ after
its passage.
