CLERK -AN ORDINANCE VACATING THAT, PORTION OF PETTIGREW STREET IN THE CITY OF FAYETTEVILT
ARKANSAS , BED4EEN DUNCAN STREET (NOW AVENUE ) AND STIF3IAN STREET ( NOW AVENUE) ; THAT
PORTION OF DUNCAN STREET (NOW AVENUE) BETWEEN THE ST . LOUIS AND SAN FRANCISCO RAILROAD
RIGHT OF MA,Y , AND A CREEK RUNNING IN . A NORTHEAISTE?.LY DIRECTION AND CROSSING IDHSCAN
STREET ( NOW AVENUE) SO AS TO FORM THE NORTHtBOUNDARY OF LOT ONE OF BLOCK SEVEN OF
PARKSUM.9 ADDITION TO THE CITY OF FAYETTEVILLE.- ARKANSAS; THAT PORTION - OF A TWENTY-
FOOT ALLEY EXTENDING NORTHWARD FROM PETTIGREW STREET BETWEEN LOTS. THREE, FOUR, FIVE,
SIX, SEVEN , INCLUSIVE, AND LOT EIGHT IN BLOCK EIGHT OF PARkSDALE,ADDITION TO THE CITY
OF FAYETTEVILLE, ARKANSAS; THAT PORTION OF A TWENTY-FOOT ALLEY RUNNING ALONG THE
SOUTHERN BOUNDARY OF LOTS ONE THROUGH FOURTEEN, INCLUSIVE, OF BLOCK ELEVEN OF -PARKS-
DALE ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS, BETWEEN SAID LOTS AND THE ST .
LOUIS SAN FRANCISCO RAILROAD- RIGHT OF WAY, AND FOR OTHER PURPOSES,
WHEREAS, a Petition was duly filed with the City Council of the City of Fayetteville, .
Arkansas, on the 20th day of September , •1954, asking the City .Council to vacate arri
abandon all that portion of Pettigrew Street in the City of Fayetteville, Arkansas, .
between Duncan Street ( now Avenue ) . and Stirman Street ( now Avenue ) , that portion of
Duncan Street ( now Avenue ) between the St. Louis and San Francisco Railroad right
of way, and a creek running in a northeasterly direction and crossing Duncan Street
(now Avenue ) 'so as to form the North boundary of Lot One ( 1 ) of Block .Seven ( 7 ) of
Parksdale Addition to the City of Fayetteville, Arkansas ; that portion- of a twenty-
foot alley extending northward +from Pettigrew Street between Lots Three (.; ) , Four ( 4 ) ,
Five ( 5 ) , Six ( 6 ) , Seven { 7 ) , inclusive, and Lot Eight ( 8 ) , in Block Eight ( 8 ) of
Parksdale Addition to the City of Fayetteville, Arkansas; that portion of a twenty-
foot alley running along the Southern boundary of Lots One ( 1) through. Fourteen ( 14) ,
inclusive, of Block Eleven ( 11) of Parksdale Addition to the City' of Fayetteville ,
Arkansas,* between said lots and the St . Louis and San Francisco Railroad right of way;.
and
WHEREAS, after due notice as required by law, the City Coungil has , at the time and
place mentioned in the notice, heard all persons desiring to be heard on the question
and has ascertained that the portion of the streetSanl alleyshereinabove described
' has heretofore been dedicated to the public use as .S streetsand aw alley:; has not
been actually used by the public generally for a period of at least five- ( 5 ) years
subsequent to the filing of thaplat; that all of the owners of the property abutting
on the portion of said stree3Asou`gM to be vacated have filed with the : City Council
their written consent to sai abaondonment; and that public interest and welfare will
not be adversely affected by the abandonment of said streetT +.41.A YS
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS: ...
Section 1 : The City of Fayetteville, Arkansas, hereby releases , vacates and abandons
alb its right , together with -the rights of the public generally, , in and to that portion
of Pettigrew Street in the City of Fayetteville, Arkansas , between Duncan Street ( now,
Avenue ) and Stirman Street (now Avenue ) ; that portion of Duncan Street ( nar Avenue)
between the St . Louis and San Francisco Railroad right-of-way, and a creek running , -
in a Northeasterly direction and crossing the Duncan Street ( now,Avenue ) so as to form
the North boundary of Lot;,lOne ( 1 ) of -Block Seven 47 ) of Parksdale .Addition ' to the
City of Fayetteville, Arkansas ; that - portion of a twenty-foot alley extending North-
ward from Pettigrew Street between Lots 3 , 4, . 53 6, 71 inclusive, and Lot 8 , in Bloch
8 of Parksdale Addition to the City of Fayetteville, Arkansas ; that portion of a
twenty-foot ailey - running along the Southern bourdary of Lots 1 through 14, inclusive,
of -Block -11 of Parksdale Addition to the City of Fayetteville. Arkansas , between said
lots and the St . Louis - San Francisco Railroad right-of-way, as same is now putted
in the office of the Circuit Clerk and ' Ex-Officio Recorder for Washington County,
Arkansas, reserving unto said City of Fayetteville , Arkansas . , its successors and assigns ,
an easement or right of way ` on, over, under, and across the _ pnrtion of said streets
and alleyshereby vacated for the purpose of crostructing , installing , laying, re-laying. .
re-locating and maintaining all public utilities now located or which may be hereafter '
located upon said vacated streetrand alleysby said City or any corporation having a
franchise or right of way from said City .

Section 2 : A copy of this Ordinance duly certified by the City Clerk, :Mall be
filed in the office of the Recorder of the County and recorded in the deed records
of the County.
Section 3 : This Ordinance shall be in effect from and after its passage.
